Credit Card Overlimit

Any ideas whats next step for this?

Posting on behalf of someone else.

Credit Card is over limit (around £450) Entering third month of non-payment (around £900 outstanding to be paid to straighten things out)

Person has no income at moment, finished uni and been unable to find work/unable to claim JSA due to uni course)

Now about to do a five week work placement (unpaid - requirement of uni course to complete course and be able to earn)

Parent able to help out with small amount of money but struggling.

Spoken to bank who say they will need to pass over to debt collection agency soon.

Person worried about baliffs etc and how to repay everything - what sort of things are we looking at happening over next few months? (in about 3 months should be in position to start paying things up again)

Hoping to avoid charging orders etc but currently have NO income for next three months at least - is it worth doing token payment route?

  • Hi, are there any over limit or late payment charges on this account that can be claimed back to reduce this debt. Do they still have statements. Have posted on another thread about this. Amy. Dont worry about bailiffs at this stage. Request a copy of the CCA. I have posted a copy of letter on Amy's thread. Sorry i am in a bit of a hurry but did not want to just read and run.     Found a copy of the CCA request letter and will get sent off, with £1 payment and recorded delivery?

    What does this letter actually do? Apart from ask for copy of the CCA - does it give person a breathing gap to get things sorted out? Ie if they do respond with copy of signed agreement, what happens next?

    Do we send to the bank dept requesting payment? ie Collections? or jsut to credit card company address?

    Regarding charges on account, would imagine there is some, but having had spoken to bank re getting current account charges back and only getting some back, worth persuing this? Guess its a seperate letter. Charges only occured in last few months.

    Worth also getting in touch with bank to explain circumstances (via letter) and ask for reduction of payments in meantime?

    Just not sure if we do one thing, then we have to do that and wait, or do all things at once.

    can't see they could get a charging order on a CC and bailiffs can't be used unless there is a CCJ in place. Any bully from a DCA boys turning up without a CCJ can be told to get lost - they have no rights at all. If it does go to a DCA, by the time they write and request a payment, your friend will be a lot nearer being in a position to start clearing it. Until then, if they have to accept token payments, then that's the situation and they have to go along with it.

    Yes, send the CCA recorded delivery. Don't sign it in case they use the signature fraudulently on a CCA.

    Yes, it's a separate letter for the charges. See the bank charges board for the templates - they are the same letters for CC's. Every penny is worth pursuing.

    Do both the CCA request and reclaiming the charges at the same time,(but 2 different letters) not separately.

    Credit card reclaim is still ongoing. So please if you have any charges get them claimed back. You send the letter to barclaycard. Check the CC statements. I think you will be surpried when you add all then charges up. It really is very easy reclaiming the charges fromm CC companies. Please dont be put off. Its not like bank charges. They are not on hold.

    Only do reclaim if you know what the charges are to start with. You need a breakdown of them. So in the meantime send off then letter for the CCA and this will buy you some time to get things sorted.
