I'm sure there was a problem a few months back with Westminster Council regarding the issuing of parking funds. I wish I could find the link but if I remember a lady that lives in either dorset or hampshire had a visit from the Ballifs regarding outstanding parking fines only to discover that it was an error with Westminister Council. Fraud was never mentioned.0

Hi guys,
I know it's been like 4 months but I just wanted to post a quick update to see if anyone can help me.
Thanks to Herbie's help Northampton County Court revoked the the order for recovery and the charge certificates.
Unfortunately, the whole episode has started again with Westminster Council sending out more notice to owners. I know I should have responded right away but I was just so p'd off and didn't want the hassle again.
Now I've received charge certificates (8th Dec) and while I did send a letter to the council (15th Dec) explaining the whole thing supplying copies of the letters from DVLA and the Northampton County Court I have not heard back from them and the 14 days deadline (unless it's working days?) is over and I'm not sure what to do now.
I'm really hoping I'm not gonna be threatened by bailiffs again and I hope I don't have to file PE2/3 forms again because that was such a hassle to get witnessed and stamped!
If anyone has any suggestions I'd really appreciate it!

I've just read this thread and found it quite worrying. Fortunately for the OP, he has never owned a car but more importantly, has never passed his driving test. I think this gives more credibility to the identity theft argument. It isn't that I'm saying I don't believe him, but would he still be able to prove these things if he had passed his test and had previously owned a car? Would this make the situation less believable? Hi,
I had a very similar thing happen to me a few years ago. I sold a car to a guy and sent off the paperwork and the DVLA lost it! Consequently they left the car in my name. When the new owner sussed this out I ended up with loads of parking/speeding fines for about a year.
What you need to do is write to the DVLA outlining your situation. If you call them first there is a specific department that handles problems of this sort, sorry I can't remember exactly what its called. I also wrote to the Chief Constable of the county I lived in explaining the situation and asking that they look out for the car. I was informed that both the DVLA and my local police force had the car on their wanted list. Al my outstanding parking/speeding fines were then cancelled.

This has happened to me too ... a visitor at my home got two parking tickets that we felt were unreasonable. I wrote disputing the fines, and heard nothing for six months. Suddenly a court summons! I am pleased to say that the debt collection company were very understanding when I explained I had never qualified to drive nor owned a car.
