I think i have fianlly decided that BR is the best option althougth like everyone i have a few concerns should i quit paying my mortgage to enable me to get thee fees together is that ok to do also i have not a bad income to be fair but alot of it is made up of overtime would this be taken into account if the OR required me to make a IPA cause toi ber honest its not techinically guareenteed but it is fairly regular or would they take my basic wage would they take my basic for my soa aswell. I have got an soa but think at the moment its a bit weak for example i have alot more going out then coming in on it has anyone posted there soa completed so i can get an idea of where to thicken up my trying to avoid having IPA next question if you dont have to IPA can they change there mind i.e six months down the line are all secured loans written off aswell please excuse my poor grammer and spelling just trying to get this down quick inorder to get replies quick any help would be great. Just a small theing to add which i thought was comical one of my ceditors rang today and asked why i hadnt paid them 950 when i said cause i havent got the money she told that was not good enough and a very poor excuse i felt like i was back at school i nearly said to her how do think the people i o 15000 to feel thankyou all so much you dont relise what a help this site and the people who post on it give keep posting god i rabbit on dont i thanks again

Hi dickoa, one of the first things you should do is talk with a debt charity, their links are all over this forum. Only they can say for sure that bankruptcy is the right move for you. It was for us, and I don't really give a damn what other people think, there comes a time when you have to think about yourself and your family.

Ok first off welcome.
Nxt ring a free debt helpline to get good impartial advice,there are a couple in my signature. You really need to do this, as if they reccomend bc then the judge will almost definately ask if you have taken the correct legal advice,if you haven't then they can refuse your petition.
If you have little or no equity in your house and it is only in your name and you are happy for it to be repossesed then yes stop paying the mortgage.You must also stop paying all creditors as this may be seen as favouring a creditor and OR's dislike this and carries a punishment in terms of a bru/bro
You are required by law to inform the OR of any income changes within 21 days,so yes an IPA can be started/stopped/increased/decreased or even dissolved at any time. If by the time of discharge no IPA has been set up you are free to earn what you want without notifying the OR. If one is running at discharge then you have to tell the OR for the duration of the 36mths that an IPA runs for with a couple of exceptions.
