lowell dca help please

hello hope someone can offer some words of wisdom...

my husband has an a debt with lowell (cap1)and has been paying monthly installments since may.

he then got a letter from them saying he owes them money for shop direct group, he has an account with additions but is paid well, no problems. a few days later a more demanding letter turns up with a few more details, saying its for a littlewoods account. i know for a fact he has not had a littlewoods account. sent the cca explaining that he does not acknowledge any debt and thinks its fraudulent. a month or so later i am still worried so i phone littlewoods and they confirm that the account number they have given is nothing to do with my husband - even said when i got through 'is that mrs e????' she suggested i send the letter back to lowell with not known at this address, but he is known at this address! as lowell havent got back to us i guess they have realised the error but who knows?

then....

today a letter drope through the door about cap1 account saying a payment hasnt been honoured and he is in arrears. ive checked the bank - all payments gone through fine. from the date of letter i guess they are talking about julys payment but i have checked and checked and its been paid

anyone had similar dealings with lowell?

it just seems to be one thing after another this week :mad:

    Based on other people's experience with Lowell, I do not think that matter's one jot what you payment history is with Lowell, they just churn out these letter's automatically.

    Did you demand a CCa for the orginal Cap 1 debt?

  • we did and he owes it and wants to clear as soon as possible, paying small payments now but hoping to offer full and final settlement asap. another one of their errors is when we cca'd them for cap1 they sent someone elses agreement, as well as my husbands. it just gets better lol

    Have you written to the Information Commissioner about

    a) sending the wrong agreement re Cap1
    b) Demanding payment for a debt that belongs to Mrs E?

    Also complain to the OFT and the Consumer Credit Association, if Lowell are members.

    Yes, Lowell are members of the CSA (Credit Services Association) - http://www.csa-uk.com/ and the DBSG (Debt Buyers and Sellers Group) - http://www.dbsg-uk.com/dbsg/.

    no we havent complained about either yet, thank you for that wouldnt have known who to complain to.

    well as of this evening the latest bit is a bit clearer, they wouldnt speak to me but when my husband phoned they said 'its our mistake erm well not mistake but its ok.....' it turns out they had the payment date set as the 13th, no idea why as we have always paid on the 20th as agreed.

    anyway a sigh of relief thank you for your help.

    I bet you that the CCA agreement they sent you wasnt valid for CAP 1 either
