CCJ Help Please

Hi sorry if this is in the wrong forum.

I have 3 ccjs 2 are 5 years old and the other 4 years old, i've not made any payments on them since they were issued. I was just wondering what happens after the 6 years, I know they get wiped off my credit file but can the creditor re-apply for another ccj once these run out?

Thanks in advance

    Hi Daz

The ccj continues to stand even though it will fall off your credit file at the six year mark.

So there's no need for the creditor to apply for another one.

However, if the creditor is going to enforce the debt (bailiffs, attachment of earnings etc) they are supposed to do this within the six-year period.

What's your total debt including these three, Daz?

The 3 ccjs only add upto £1100 im only £4500 in debt so its not too bad! I want to know if its worth paying these ccjs off or just leaving them as they will not be on my credit file after 6 years, nobodys bothered me for the money. Just curious what others think is the best way to go. Thanks for the reply

    Hi Daz

With multiple debts totalling less that 5k and one (or more) ccjs you qualify for an Administration Order. They don't get mentioned much on this forum, probably because most folk have debts over 5k and/or no ccj.

    The advantages are:

    1. one monthly affordable payment to the court

    2. interest and charges stopped

    3. no fee (well it's taken from your monthly payment)

    4. no enforcement of ccj (e.g. bailiffs) possible while the AO is in force

    5. 'composition' of the debt so that you ony pay a set percentage, with the rest being written off by the court.

    6. If you have Council Tax arrears these can be included (Local authorities don't like this)

There's a fact sheet here but feel free to ask for further info as I have got quite a few of these for my clients at the CAB.

My debts are ok everythings under control so i dont need to go down this route. These ccjs are from when I was young and stupid and living at my parents. I live in my own house now and i was just tallying up how much i owed, including these ccjs i knew i had but didnt bother with as nobody has bothered me! What I would like to know is after 6 years and the ccjs dont appear on my file, anybody who searches my file wont see weather ive paid them or not. So if nobodys bothering me for the money whats the point in paying it if there is going to be no record of these ccjs after 6 years.
