Do I have a case for constructive dismissal?

Since I was in charge of the personnel files I had access to my own file and there was nothing - I never had an apraisal in the 22 months I was there.
I have emaild the MD and asked for 3 months pay and a good reference and I will sign a doc waiving my rights o any further action. He has tried to call me but we keep missing each other.
I have some interviews with agencies today so hopefully I will be working again soon2014 = New Year, New Me0 -

I'd stay by that phone if I were you.

Hi Mennie;
That's good. DON'T let yourself get freaked when you talk to the agencies. I've seen it twice; and I was the victim once. In my case, when I left my parting shot to the MD was, in my opinion, amusing. Not in his! And I spent three months worrying what sort of reference I would get (turned out to be a very good one - god knows why!). But that worry came over at interviews; and I was worrying about something that might never happen. Later, I had a staff member leave without notice. And after two months she rang to see if I had rung all her agencies and rubbished her. No-one had rung anyone - but she was so worried about the way she had left, that she came over "all twitchy", and the agencies wouldn't put her up for a job.
Just explain what happened; and say that when you read what had been said you felt you had to leave. If they ask anything further; like "can we get a reference"; just say that of course they can; but that at the moment the firm is trying to ensure that they don't get into Data Protection trouble, and it's just a great big negotiation with them trying everything to make sure you don't get them into trouble, and you making sure your position is protected.
If they understand that, they won't ask anything else. If they don't (and there's a reason they are recruitment consultants, and it's not because they're clever enough to have a real job), then they won't ask anything else either.
Be sure you're not taking any baggage into the interview, and you'll be just fine.
