Can anyone help!
I work for an employment agency as a HGV driver
Just recived my first pay slip off them and I queried there logic on my overtime payments but i am not completly satisfied with there answer.
My issue is as a driver I have to have a break of 3/4 of hour after 4.1/2 hours driving by law.
My agency Say I have to complete 8 hours work before I qualify for overtime
so if I complete 10 hours work they take of 3/4 of an hour off the gross hours worked (thus taking my break off my overtime) there is nothing in my contract to say this so to me it is a grey area.
My logic tells me once 8 is complete take off the 3/4 hour break thus giving me 7 1/4 hours, should overtime be paid after this time not after 8hours

If you are not paid for your breaks, then the agency have done it right.
If you work from 10am till 6pm, presumably you get paid for 7 hours 15 minutes.
If you work 10 hours a day, from 8am till 6pm, you should have a break at 12.30pm, and another at 5.45pm, so would only receive 9 hours pay (if you aren't paid for breaks).0
