Yeah but even though I currently pay half of the nursery costs and everything else when he is in my care (Clothes, Food etc) I would still have to pay 15% to the CSA?

If you went through the CSA you would pay 15% of your net salary and that would be it. You woudn't pay half the nursery costs as it is expected to come out of the maintenance she receives from you. You would get 1/7th reduction for every night your child spends with you. For example, if you earned £300 per week net, your calculation would be £45 per week. If your child stayed with you for 3 nights, you would get a reduction of £19.26 (3 x £6.42) approx. So your weekly payment would be £25.74, give or take a few pence depending on rounding.

be careful if at any time she wants to stop you seeing your child she can
do that and fighting her through the courts with solictor,s bills will cost a
    fortune and YOU WONT WIN.
You do not have shared care even if you have the child 50% of the time.
Smile sweetley and enjoy the time with your son.
The CSA is not some where either of you wants to go so keep it friendly.

Shared Care - Child Support Agency website.

The system is totally unfair when it comes to shared care.

I'm not sure if you can put in a claim for CSA too, you used to be able to, the website might tell you more.
    Torgwen.......... :) ...........
  • Thanks for all the replies. I appreciate it.

Our relationship is still "quite" friendly even though I really dissagree with the benefit situation. We try to keep it friendly because our Son is the main priority and I don't want him picking up any bad vibes. I'll take a look into a few things but I guess the end result may be to just leave it although I totally dissagree with it. She's more than happy to let me have 50% of the responsibility when it comes to me paying out for things but when it's upto her then she takes the full 100%

I meant that not all PWC are like that. I would like to think that women like these are the exception rather than the rule :) It's a real shame as these kind of PWC give the decent ones (yes, just like me!!!!) a bad name

i would say to you to contact CSA yourself and let them know that hes spread between the 2 of you personally, as this constitutes as shared care for him plus youd be covering your self sooner rather than later, as im sure they will think youre just trying it on when the time comes that they contact you. im sure they will contact you as well being as your ex is getting benefits and it is a requirement that she gives as much info as she can about you too, so make it your priority and there will more peace of mind for you, hugs
