Please Help, I am being heavily harassed

Hi, I am severley disabled and I have four children so my DH already has a load on his hands.

Last year I entered into a DMP plan - one of the debts got left off and for the last six months I have been trying to sort out with the CCCS to get it put on.

They admit it is their fault they have not sorted it, but this debt has been passed to at least 3 different debt collection agencies.

The current debt collection agency is making approximatley 50 to 60 telephone calls a day, and no, I am not exaggerating.

They are calling my DH mobile and the house phone (I have no idea where they got the mobile number from)

It has now got to the stage that when the phone is answered on the mobile, they don't say anything and then when the phone is put down they send a blank voice message knowing that it costs to pick these up.

Yesterday became too much, and we had to change my DH mobile number that cost £35 - he has had that mobile number for the last 10 years so this is very upsetting.

Now, they are ringing the house phone every 15 minutes. I have just got BT choose to refuse ordered but need to wait for it to be activated.

All this is costing extra with money I don;t have. I am sure they are acting illegally. How can I stop the harassment or take things further?

The company involved are called Murray White & Co and they are based in Glasgow.

    Have a read through this and write a FORMAL COMPLAINT letter quoting anything that they have broken and given examples.

    As for CCCS have they sorted this out for yet?

    Hi, no they haven't sorted it yet, they say it will be sorted in September but have been taking the extra money since January.

    I rang in March, then April and May and was told the same all the time that they couldn't sort it until they had paid that month's payment, so it was always the month after when they told me it would be sorted.

    This I think has been the problem, they keep forgetting despite my phone calls and emails.

  • Protection from Harassment Act 1997

    Prohibition of harassment
    (1) A person must not pursue a course of conduct—
    (a) which amounts to harassment of another, and
    (b) which he knows or ought to know amounts to harassment of the other.
    (2) For the purposes of this section, the person whose course of conduct is in question ought to know that it amounts to harassment of another if a reasonable person in possession of the same information would think the course of conduct amounted to harassment of the other.

    If you are receiving the amount of calls as you state, keep a diary of when they call, the name of the caller and company, speak to the person on the other end of the line and state that you feel "HARASSED, ALARMED AND DISTRESSED" and that if the calls continue you will report them to the police.

    If the calls continue report it, ensure you state that the conduct of the company is causing you distress and you feel harassed. The police should act on it and tell the company to stop. If the calls continue then arrest/prosecution is an option.

    You can also deal with this in civil courts but I suggest you talk to a legal professional or CAB for more advice.
