Question about car

Hi All,

My friend is currently going through bankruptcy in Scotland, and we have a bit of a difficulty.
Three weeks ago, the administrators turned up at his premises and seized what they thought was his car, but its actually mine. I bought it from him in May 2007 but he is currently driving it and is the main policyholder on the insurance (as I have a policy on another car and can't use my no-claims discount twice etc...) which I paid for.

I am the registered keeper on the V5, and I paid for the insurance although it's in his name and I am solely a named driver on it. The administrators claim that the fact that he is the policyholder makes it his car and to make matters worse I have no receipt for the purchase as I've known him for 15 years! (Although I have evidence of the personal loan I took out for the purchase)

The administrators don't believe that this is my car, and while I can understand that it might look dodgy to them, its not as if I bought it last month, its 15 months since I bought it, before the bankruptcy was even mentioned! All the paperwork was transferred at the time of purchase, but I still cant get my car back, the company is making things very difficult for me by not contacting me when they say they will - they just seem to be holding onto the car in the hope that I'll get bored and go away, which is obviously not going to happen.

Can anyone give me any advice on how to proceed with this please?

You need to get legal advice on this. Its not something we can do here for you at all.

Gather all your info together (proof of V5, loan agreement etc) and hot foot it to CAB as a starting point.
  • Rightyo, I'll do that asap.

    Thanks!
