Barclaycard Problem

Hi,

I have a problem with Barclaycard who have just taken a large sum of money from my Barclays Current Account without my knowledge. I have now been left with the situation being that its a over week until I get paid again, and I now have no money for groceries and travelling expenses for work.
I have spoken to Barclaycard about this and their responce was that when I took out the card I signed an agreement saying that I agreed to let them take whatever money out of my account if I go over my credit limit and they do not need further consent from em to do this.
With this, I now have a 3 part problem and I don't know the solution.
The problems are:
1). I set up my card account online and never, as far as I am aware, signed any agreement with Barclaycard. I have checked any print offs I have for the card and there is no mention of this clause.
2). The account had the card cancelled over 6 months ago and is only active as I am paying the money off. Its been over its £0 limit for 6 months so why take a payment now, when I have been regularly making payment through my DMP with CCCS.
3). Barclays are no longer in control of the account as it was passed on to a collection agency, who themselves have told me that the money should not have been taken and it hasn't been payed towards my account.

I am very sorry for the long post, but I am really at a loss about how to deal with this one. I thought about writing to them to get a copy of any agreements I may have signed, but don't know what I would do if I did, or did not, recieve them.

If anyone can advise in anyway I would be really grateful.

Thanks in advance,
Mandoo.

briefly yes the can take money from one account to service another. bit stinky though if you are paying them off anyway through a DMP.

suggest it may have been done because barclays has had a review and decided that 6 months is enough time to sort it out. though if a dca is involved then it is a bit weird that the dca isn't trying to do this rather than barclays

suggest that you speak to your DMP advisor for advice on what the next step is

Looks like there's nothing you can do . We on the forum have come across this many times . The advice when people get in to difficulties is to set up another completely separate account. Afraid its too late now . As far as online applications go, the CC ACT was changed to cover the Internet , so not having a signature is not a reason for the account to be deemed unenforceable .
