Walking possession order

Hello

I have a friend who is in abit of a state regarding non-payment of council tax.

The debt was passed onto a collection agency and he made an arrangement to pay £89 per month. He has since been made unemployed and has not been able to keep up with payments.

He received a letter today from a bailiff saying they will gain access tohis property with the police and locksmith on Friday if he doesnt pay the full amount of £545.

What he needs to know is whether they have the right to break into his flat with the police and take his goods.

I would appreciate any advice as I dont know what to advise him for the best. He has tried to come to an arrangement with the bailiff but they just say they want thw whole amount which he cannot pay. At the moment he cannot pay them anything.

Appreciate any help.

    You'll get far more information about this on the DFW Board; I think that non payment of Council Tax is something that bailiffs can be used for, but I'm no expert on this.

    Yes bailiffs are used for non payment of Council Tax, I have seen them on the telly trying to get the money!
  • and if escorted by police they can access the property. Your friend needs go to go to the cab who can try and negotiate with the balliff on their behalf.

    Remember the worst case scenario is prison, so this is very serious and needs to be sorted out asap.

    Okay, lets not get carried away - prision is waaaaaayyyy off, don't panic. Bets advice I can giv as someone who's been there, done that is to get your mate to contact the council, and talk to them. 9 times out of 10 they call the bailiffs off etc. The bailiffs won't do anything without their say-so, so your mate needs to get back to the council, send in proof of having lost his job etc, back it up in writing.
    This year I'm getting organised once and for all, and going to buy a house with my wonderful other half. And that' s final!
