Just Got Back From Court

Hi

Just got back from local court who granted a forthwith order to one of our creditors, therefore we are to get a charging order but with no enforceable sale.

We had a representative from CAB with us who disagreed about it as we have not missed a payment on our order from the court through the CCJ. But the judge wasn't really bothered about that !!! He did grant the forthwith order more or less straight away but did go on to explain that so long as we kept up the payments then the creditor would not be able to force us to sell :j ( i did give a sigh of relief at this stage ).

It wasn't as scary as I thought it would be and we were only in the room about 5 minutes, but am a little disappointed that the creditor was granted what they wanted !!!!!

So really can't understand the point of a CCJ if they can get a charging order anyway to make it a secured debt !!!! :confused:

    I remember some time ago reading on here one of the experts wrote that, if you own a house, ultimately there is no such thing as an unsecured debt.
    I used to think that good grammar is important, but now I know that good wine is importanter.

    Sorry it didn't go your way crystal, some of these creditors are just bully boys, we are in the process of Northern Rock applying for a charging order, following your post, I've no doubt they'll be awarded there request :mad: :mad:
