Still chasing me for old CCJ

Hi Everyone,

In 1993 I had a CCJ against me for a loan with Llyods Bank.
I used to pay £10 per month and over the years I presumed it was paid off.

But in 2006 I got a letter from a debt collection agency stating that I still owed £1300 which was quite a bit more than the original loan.

I disputed this but was told it was correct.

However when I phoned the County Court where the judgement was taken out, they had no evidence of the CCJ on their records and as their files have all been transferred to computer, there are no paper copies of old CCJ's.

I now have a letter from the Debt Agency stating they are applying for a CCJ for this debt.

What would be the best corse of action here?
I am thinking of disputing the debt totally as I believe it was paid off (although I cant prove it) and isn't the onus on the company to prove I owe it?

Any guidance would be greatly appreciated.

Why are they applying for a CCJ if they already have one? Do you not mean that they are going to start enforcement proceedings?

This debt agency obviously don't know about the old CCJ as it now doesn't exist.
I know, its real complicated aint it?

OK, If they twig that there is an existing CCJ then they can apply to the court for permission to enforce it. I think worry about that if it happens.

Here is a thread which contains copies of the letters which will be of interest to you.
