Northern Rock - What's Your Experience

Hello Everyone!!

Thought I would start a new thread to see what peoples experiences of Northern Rock and Debt Management Plans are? We are due in Court very soon with NR and I am nervous, so some internet forum moral support would be good!! Heres my situation;

NR Together mortgage £105000 taken out about 2004 on a 3 yr fixed, 84 secured and 21 unsecured.
In 2006 went onto a DMP with CCCS after finding we were struggling with growing debts. Included the unsecured loan on the DMP which NR hated.
October 2006 recieved a phone call from NR, 1 and 1/2 hrs on the phone in which they scrutinised our budget, and eventually as I had been overpaying on secured element on the loan by £20 per month I ended up offering them that towards the unsecured just to get them off the phone, however, in the statements it shows that they did not always attribute the extra toward the unsecured anyway.
2007 - constant letters and phonecalls from them, kept telling them we were adhering to the DMP, and are fully commited to repaying all of our creditors including them.
2007 - switched secured element away to another lender.
April 08 - they threatened court action, I requested nicley that they suspend litigation as we are committed to repaying our debts, they said no.
June 9th 08 - they went to court and got a CCJ requesting full payment forthwith, I wrote asking for a redetermination, then applied for a redertermination.
June 10th 08 - they went to court and got an interim charging order ( i didn't even know they were doing this) they said the next hearing would be 23rd july, I requested twice that the hearing be moved to by local court.
Wrote to CEO at NR, and got a letter back stating "although legal action has been taken to ssecure a charging order we can confirm that this will not be enforced and that we are happy to accept reduced payments at this time" - yippee I thought, no court then, wrote to them to confirm.
July 23rd - they rang me to say I had misunderstood the letter and they were still in court TODAY! well I couldn't get there then!!! Rang the court to explain.
Hearing Adjourned and transferred to my local court for 29th August.
Have just had a letter from them now threatening us with baillifs or an arrestment of earnings as we have not adhereard to the CCJ!! this is ridiculous, they have already agreed to accept reduced payments!

i am sooooooooo confused, angry and upset. I now have less than 2 weeks to the hearing. They have been horrid throughout this and all I have tried to do is show as much commitment as I can to repaying my debt with them. If they get the CO it will be worthless, given the current property prices we would be in negative equity so they wouldn't get their money anyway, and believe me, if I had the money I would give it them as I want them off my back. I have been so stressed with this, my marriage has suffered as a result, and I feel that they have been awful.

What is everybody elses experiences?

Cheers
B!!

  • Hi ~ so far NR have been very good with the OH ~ they did tell a few porkies in the first instance (when the DMP was being set up) but stopped as soon as they realised we knew what we were talking about. They have accepted reduced payments from the OH for over a year now ~ this is a payment of £72 per month for a £25K unsecured loan. We last heard a few weeks ago when they threatened legal action to secure the debt ( a charging order) as their normal policy is only to accept reduced payments for 6 months and the OH has had 12. As what they asked for on the SOA was technically incorrect (they wanted my salary details as well as the OH's ~ the debt is all his ) they went a bit quiet when this was pointed out by Payplan # we have heard nothing since
