    yeah to be honest if she gets lumped with the whole amount, its nothing she wouldnt deserve - as she caused the mess in the first place (she secretly refused to pay the mortgage & bills despite living there for 2 years!). I'm not in touch with her and I think she may be planning BR herself eventually. I've tried to be amicable and help her with this but I need to start thinking of number one as its two years on and I desperately need to move on with my life. Many thanks for the advice.

    I think you should forget being amicable and start looking after yourself. It's a bit of a roller coaster but certainly not as bad as you expect and the relief afterwards is wonderful.

    Make sure you remove any spare cash from bank accounts and credit cards. You need BR and food money. OR usually turns a blind eye.

    Re bank account. Mixed advice on this one but I opened a Coop cash minder before BR, told the Coop and told the OR and no problems at all.

    If one of your credit cards is Barclays your phone will be ringing off the hook. Sometimes people advise changing the number but I couldn't stand the hassle of that. Problem is if you have a slow OR they are not simply going to take your word that you are BR even quoting the number. If you photocopy the court form declaring you bankrupt and send it that will stop the hassle.

  • Thanks folks. I guess every situation is different - I was sure mine was exceptional but on reading more threads and posts, there are a lot of us in these type of situations! Its good to know i'm not on my own.

    I'm generally concluding that although I'd have like to avoid it, Bankruptcy is the only route - & however difficult the process - that thick black line under my past would be a blessing!!

    But oddly it would seem that for me - it'd be better to be renting a house on my own, rather than with my girlfriend, whilesoever the bankruptcy is happening!

    Am I right in thinking that any change in housing situation in the 3 years or so after being discharged has to be declared to the OR? (as well as any change in job/income)?

    Not sure about changes in 'Housing Situation' EL, but certainly, if you were given an IPA/IPO, all changes in income/financial circumstances need to be reported to OR, within 21 days. If, on the other hand, you did NOT receive an IPA/IPO then you would not need to inform OR/Trustee of any changes once you have been discharged.

    Not sure how you would be affected if you were, for example, 'a tenant of your gf'.

    As things stand, I would have surplus income after all my debts are taken away, because I currently live with my girlfriend and it shares costs.

    However, if I were to move to other rented accomodation and therefore have my own rent and bills to pay, this would change things massively. Would an OR be at all suspicious of something like this? - e.g. want to know why I have had a change of circumstance just before bankruptcy?

    Hope you can help and thanks for everyone's posts to date.

    Why, EL - whose name is on the current agreement?

    Couples fall out, and break up, all of the time.

    My GF's name is on the existing rental agreement where we live now (mine is too, but only as another person living there). I didnt try to get my name on the rental agreement because I knew my Credit record was so bad.

    But there is a house I could rent through someone I know who wouldnt 'credit check' me.

    It'd be a 'move of convenience' if you like!? Does that sound bad?

    I would imagine that there are worse moves, EL.

    So what you are trying to say in a round about way is if you moved to rented,got out of paying an IPA then when discharged moved back in with your GF, you would be ok. Thats ok providing you have no surplus even in seperate rented. If you do then you would in theory have to stay put for 3 yrs(36 mths)untl the IPA is finished.

    Unless of course this "someone you know" is going to say you live there when you don't.

    No sure what all this is about:confused: Please don't forget your bills would drop,seeing as only one person living there and not 2.

    sorry for any confusion - there's really nothing going on here apart from as you mentioned in first paragraph above, D - having a different place to live would leave less or no surplus income, making an IPA less (or nothing). I'm not suggesting trying to pull the wool over anyone's eyes (esp an OR!!) but simply that I would change living arrangements (i.e. live elsewhere) if it were a better option. The bottom line is that I've been screwed by an unpleasant ex-wife and I'm trying to make the best of a bad situation. :o

    Yes i do understand that. What i can not understand is why you would want to leave living with your girlfriend just so that you had no IPA. An IPA is paying the OR for his services and then any ceditors.A sensible idea would be to post your i&e as if you were living on your own then see if an IPA will still be applied.
