11 months into BR, now letter from OR!!

Hi All,
My automatic discharge is 21st September. I have just received a letter from the RTLU asking me to confirm the source of the funds I used to fund my BR petition; I have 21 days to respond.
During my OR interview, I admitted that I had used some of my bank money to pay for the petition, and this had taken me overdrawn. The lady in the interview did mention a BRU, but said she would speak tot he OR and explain that I had been honest and fully complied with them. I have since heard nothing else.
Why are they now asking at such a late stage a question which I have already answered? Given that I will reply at day 21, and this will give me only another 2 weeks until automatic discharge, what can they do?
Thank you.

If they move fast enough, they could, if they wanted, slap a BRU on you. They can do whatever up to AD date. Personally, I would write to them on day 20 (within 21 days!) and tell them everything they need to know. Second class stamp too....
They may have no intention of a BRU or anything else, they may just want the information.
And I better go and have a look at where I got my funding from.....0 -
the letter also says that if I borrowed the money from a friend or relative, can I supply their name and address.
This makes me think that the notes in my file didnt record exactly where the money did come from, otherwise they wouldnt ask again?0 -
Or perhaps they just want to make sure that you have included the friends who you could have borrowed from, in your BR - or that you haven't paid them back, thus making them preferential creditors.
Just tell them what they need to know - I think you are probably worrying yourself too much about it! Especially becuase you are so close to the finish line, so to speak!0 -
thank you, i hope I am worrying too much.0

I understand you worrying, my AD is 28th August this year and I am more stressed now than I have been the whole of the BR.0 -
Helping out a friend who had a similar request. After automatic discharge in this case though.
Responded and seems to have gone quiet now. It looks like they are either doing some research or just tying up loose ends in your file.
I think if it were something more ominous you would have had a lot more enquiries than this.

, it makes people wonder what you have been up to.0 -
thanks. just so that I know, how long does the OR need to apply for a BRU? or would they simply delay discharge if they didnt have enough time?0
-
Automatic discharge is just that - its automatic and cannot be delayed.
If they are to apply an IPA or BRU it must be before AD date (unless you get ED, obviously!) as they cannot apply anything afterwards.0 -
I have read on another forum that if the OR is going to impose a BRU they usually start the process 6wks before AD. It is pointless doing one before that as you have restrictions anyway with bc. This way it more or less starts when your AD come through. Perhaps they found out you never told them they had made a mistake with your IPA!;)Free impartial debt advice available from: National Debtline - Tel: 0808 808 4000 | The Consumer Credit Counselling Service (CCCS) - Tel: 0800 138 1111 | Find your local Citizens Advice Bureau
