cca, can I do this?

Mr Bee got into difficulty with his credit card a couple of years ago, as a result, it got sent to a dca.
Now this dca (I forget who) were reasonable, accepted what we offered in payments, all fine and dandy.
Then for no reason, it was sent to another dca who have given us nothing but hassle and have proved that they could not organise the proverbial in a brewery.
I cca'd them and got the, 'we have asked original creditor for it' letter which was over a month ago, they received original letter asking for cca early july.
What I want to know is, do I have the bargaining power now to ask them to refer back to original creditor? I'd rather it get paid off but I don't want to pay anything to the dca as they 'lost' our first payment then kicked off demanding that payment again, plus more. They're phoning daily now which doesn't bother me as I find it amusing to wind them up until they hang up on me - they do get to Mr Bee though which isn't nice.
What to do, oh wise ones? :beer:

It doesn't really give you any bargaining power other than you do not need to pay it until they provide a copy of a valid cca. If they do provide a copy then you can try to make arrangements to pay - on your terms.
If you have sent all the letters for this (original request, 12+2, 12+2+30), i would forget about it for now and just concentrate on any other debts. When that is cleared then i would maintain the payments that you are making towards the debts but pput it in a savings account until you have enough to cover this debt. If you have not hear anything from them after 6 years the debt will be unenforcable - even through court. If they do provide a copy of the cca then you may be able to make a full and final settlement offer using the money you've saved.
There is also a template letter available to stop the harrassing phone calls. Just insist that all communication must be in writing and do not speak to them (hubby too). Unless of course you want to wind them up again.

Just waiting for confirmation of 12+2+30 letter being delivered....I think it may have been though as they've not called for 2 days now.
Problem is, mortgage is due to end it's fixed rate next year so credit rating damage limitation will help a lot.Debt free in 2010 :beer:

If he has told them in writing that you can speak on his behalf they have to speak to you. All DH creditors hate me with avengance, they still have to talk to me though.

Personally I think that might be a good idea.
They will not hesitate to use every cost effective tactic against you, so why not a little table turning?
You must be aware of the legalities of doing so by now, but you only need to take it as far as you are comfortable with. Maybe it will give you the breathing space or bargaining power you need?
In the end it is a legal right that you have. How you choose to use it is up to you.
