who is entitled to minimun wage

my employer has a strange way off paying us .
I work in the beef industry and we are paid according to production the more we produce the more we get paid its called pool system .
Sometimes we dont work a normal day but we do other work .If this is the case we are paid hourly .Other employees (mostly polish /russian ) are paid hourly .From what I gather they are paid £5 per hour . Is this legal ? Is it legal to pay foreign workers less than locals ?
Also my pay slip says "pool " but never any details off how the final figure is reached .No breakdown on a daily basics ,so on any given day my pool could be below the minimun wage and I wouldnt no .Is this legal ?
To be honest there is a union but they wont fight for the foreigners because they wont join the union ,and the union agreed to the pool system before I started there .

What you work is effectively piece work.
From the DTI website:
Fair Piece Rates
From October 2004, the Government proposed that employers have to pay their workers the minimum wage for every hour they work or a fair piece rate initially set at 100% of the minimum wage. The rate was increased to 120% of the minimum wage in April 2005 at which point most homeworkers will receive the minimum wage.
The Government has produced guidance pdf (47Kb) on proposals to introduce fair piece rates for output workers, including homeworkers. A partial Regulatory Impact Assessment pdf (82Kb) estimating the costs and benefits of these proposals is also available.I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals.
