Goods delivered before credit agreement signed

The legal position is quite clear. If the credit agreement does not comply with the Consumer Credit Act 1974 then the Act prohibits the court from enforcing it against the consumer. I don't know if the absence of the consumer's signature on the credit agreement counts as a failure to comply with the Act, but I would guess it does. So, on that assumption, your friend can refuse to make any repayments and they can't successfully sue him. (If he tries to deny receipt of the goods then of course that is fraud.)
The moral position is even clearer. Your friend owes the money and should pay it.Eh?? I give up!! Towel is getting thrown in here!0 -
A DD mandate does not need signing these days. You can arrange to pay all sorts of things (car insurance, utilities, etc) on line with out a signature.
