Bailiff help

Hi can anyone offer me some advice please.

My partner has received three letters of Removal of goods today 13-Aug and it states they will return on the 15-Aug to collect.

As yet they hav'nt ast the front door, so they have no idea on what they can collect!!

Their is no mention on the letter of the Magistrates court bailiff, just a company name Jacobs Certificated Bailiff's, do these carry the same powers and comply to the same rules of trading.

She has only been given 2 days notice and is in no position of settling the combined 2k amount, nor does she have anything in the house of value, how ever she does have a car of which she uses to get to work and after reading some previous thread this could be taken.

Am i right in understanding she should be contacting the local council and try to make aggrements with them and not the bailiff's.

Sorry i forgot to mention, she beleaves its for council tax, but is not a 100% certain, on the letter there is a council Ref number.

Any othe pointer or suggestions are welcome.

Thanks

  • If it is for council tax they cannot force their way in or have you nicked or have you sent to prison. I would phone the council up and explain what is going on and take it from there. I would park my vehicle as far away as i can from my house. See if the council will take the debt back ?

Surely it will say on one of the letters who the creditor is. If it is for Council Tax there should have been reminders, she can ring council but they may wll say she has to deal with bailiffs. If it isn't Council Tax then she should ring bailiffs to find out what it's about. UNDER NO CIRCUMSTANCES OPEN THE DOOR WHEN THEY RETURN. Speak to them through letterbox or upstairs window. Park car in next street. Bear in mind each visit by bailiffs costs and is aded to debt.
If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales

Thanks for all your advice, they have been back this am with simillar letters however, it now states she has 24 hours to contact or "Alternatively we may make recommendations for an application for comittal to prison"
I'm sure this is design to scare.

There is also a note at the bottom and i quote "NOTE GOODS AND MOTOR VEHICLES MAY BE REMOVED IN YOUR ABSENSE"

it appears that shes had the removal action first then the notice letter, i think they have made a slight mistake here.

She is going to contact the council today to try and straighten this all out.

    again thanks for the advice.

if you let them in then the next time they can break in if they have done a walk in possesion
  • DO NOT DO NOT DO NOT....let them in

Ive been doing battle with bailiffs for the last 3 months for council tax arrears...has it actually gone to court/liability order????

My bailiff has been sweet talking me into a payment arrangement which must be signed in my house....he must think Im nuts...call the council in the morning and theres probably more knowlegeable folk on here who can give you a link to specific bailiff advice.

Do not leave any windows/doors open...and do not open the door to them

Sorry I cant given any specific advice someone will be along soon with more practical advice

I know nowt about bayliffs but the user herbie21 is an expert. I just had a look and they aren't online at the moment but it might be worth searching for their recent posts and having a browse through for one that answers your situation

If you aren't sure how to do this then...

Click on the search option at the top of the forum and click on advanced search, type herbie21 into the search box and click on the name when it comes up dropped down below where you are typing. Press enter/return.

This will bring up all of herbie21's recent posts

All the best, sorry I haven't got actual advice but I figure it is best left to the experts rather than me meddling (and herbie is defnitely an expert)

Thanks for all your advice guy's, its been a great help!!!!

At this point she has no idea if its gone to court/liability order, we are guessing she would have received some form of a letter and has she hasn't had this we are guessing not?

Update: My partner has contacted the guy and offered £100 a month and he has refused and has said he wants at least £500 up front and £200 month her reply to this was i can't afford that, his response was "thats not my problem, failure to meet this and we will be round with a van tomorrow at 12".
Shes contacted the council and they have said they can only take the debt back if the bailif is unable to gain access to the property or unable to make an arrangement with you.

So it looks like she has no choice, but to try and ride the storm, She is going to send a letter this weekend to the council and the bailiff, detailing the offer made and that its been refused and that the money offered will be available on the 1st of every month should the council choose to except the payment.
