Fee waiver if not working BUT not claiming benefits either

Two friends of mine are going to be going bankrupt soon and I was wondering, I know you can have 150 pounds waivered off the fee if you are claiming benefits. Does anyone know if the fee can be waivered if they are not claiming but just living off their husband (the wife isn't working). Do they need proof of no income? If they do, would it be worth them putting in a claim or would this affect the OH in any way?
