HELP & ADVICE NEEDED PLEASE

Last year I had some pretty serious financial problems which caused me to become quite ill and depressed. During this time, my daughter missed nursery on a few occasions and I didnt pay the fees as often as I should have done. When my daughter started at the nursery they told me that if payment hadnt been received for five weeks, then they would issue a bill. Even though I was sort of aware that I had not made as many payments as I should, I didnt worry about it too much because they didnt issue a bill (niave I know).

I have now been issued with a bill for just over £3000 which I was unable to pay. This has now been passed to a debt recovery company who telephoned me yesterday and have requested payment in full by the end of the month, but they have given me two weeks to come up with a proposal. I have offered £50 per month, but they said they wanted £750 and they have asked me if I cannot take out a loan. My credit history is shot, so there is little chance of this. They are threatening legal action if I dont pay.

My daughter still attends nursery, I have been making regular weekly payments for the last few months so the debt is not getting any higher.

Can anyone advise me on how to deal with this through the Debt company. Obviously I have not signed a credit agreement, so if they take me to court, what will this entail. I am concerned that they are encouraging me to take on finance as I thought they were not supposed to do this.

Any advice would be appreciated.

    I do not have the answer but as well as posting on here, have you thought of ringing the CAB or any of the debt help charities such as the CCCS or National Debtline to see if they can give you some quick advice over the phone, as a matter of urgency?

    Hi,
    Have you not thought about sending your little one to a free nursery?
    Where i live there are lots of nurseries within primary schools where children can go for free.
    It might be worth enquiring about, and would save you some money.
    I Hate Jobsworths!!!
  • Have you double checked the amount they say you owe? I remember reading on a thread a while ago that a nursery had greatly inflated the outstanding amount.

    My little one will be changing to nursery in our local school after christmas, so that will help as she will be entitled to the free places then.

    I think the amount is right.

    Just wondered where I stood on a legal perspective.

    CAB might well be where i go next
