Price drop on phone, my rights?

Hi All, hope this is in the right thread.

I recently bought 2 phones for £99.99 each from O2 Online, around 5 days ago. Today O2 have dropped the price on the phones to £79.99. meaning I have lost out on £40.

What rights do I have into getting this £40 back? Am I best just sending O2 a strong email asking for a partial refund or should I return the 2 phones and then re-order them at the lower price?!

Many thanks, Alan.

I would phone and/or email them NICELY and ask if they can simply refund the difference to save you the hassle of sending them back and reordering them. You don't have any "rights" as to the drop in price - its the luck of the draw that you buy goods just before they are reduced.

If they won't refund the difference - (which would be a nice goodwill gesture - they don't HAVE to do this at al)l - then simply return for a refund.

What is the law regarding returning items, am I allowed to do so without any hassle within a certain time period?

Yes 14 days as I had a problem with a motorola on Voda Phones 4 U wouldnt give me a refund after 8 days the phone went kaput, so I phoned Voda and they gave me a full refund, £15 good will gesture, and said phones 4 you were in breach of fair trading laws, and said they lied when they said that it was vodafones policy, so phones 4 you were 100% in the wrong.

This is correct the distance selling act says you can return within 14 days i think this includes the postage costs too
    .
  • I think you'll find that if you are returning goods as you no longer want them as opposed to them being faulty or incorrect then postage costs wouln't be included.

My understanding is the only time this would be different is when the supplier has a policy of offering a free return service.

    Seems fair to me.

    Distance selling regs.

Sorry to sound pedantic, but it is not an Act, they are Regulations.

Also the cooling off period is 7 working days NOT 14. However 02 may have different rules, check their terms and conditions.

However you have NO right by law of a price decrease.

As you bought from O2 online, you can return the goods to them for a full refund within 14 days of date of receipt under their 'Change Your Mind Return Policy'. If the goods were faulty they say you have 28 days.

O2 refund the full purchase price, including initial p+p costs. They even provide a FREEPOST returns address for you to return the goods. Get a certificate of posting, in case they say they don't receive the goods.
O2 accept a certificate of posting as proof they were returned.

Note however that O2 limit the amount of handsets you can buy in any given period (I think its 2), so don't plan on re-purchasing them straight away. Look at it this way, if the phones had increased in price by £20 each, would you be sending O2 £40 extra?
