Stressed & a bit scared

Hi All - Not been on for while as been busy BR-ing, so to speak. Have moved to rented accomm and booked BR date - 4 Sept. However, just got a letter from loan/cc company entitled 'Legal Action pending' threatening solicitors action and bailiffs and earnings attachments, etc, etc. I know these letters are meant to scare and hey, its worked. So, my questions are these: have they enough time to get a CCJ before BR and an attachment to earnings/bailiffs? Do I ring them to stave them off and tell them I've taken their advice and contacted the CCCS to discuss my options? I've not spoken to them since I missed my first payment in July. Or is it best to ride it out and keep fingers crossed I'm BR before it gets that far. As you can tell I'm all panicky! It doesn't help that I can't get on this forum very often as have no broadband in new place yet! :eek:

Hi Skinty,
Four weeks isn't long enough for them to be able to issue a County Court Summons against you if your bankruptcy date is 4th September, and it's more likely that they're just scare tactics.
In the unlikely event that the wheels are already in motion, you'll be able to attend Court and offer a token £1 pcm, which the Judge will almost always accept, especially if you've prepared a budget proving that you've no disposable income to pay any more.
Just be certain not to avoid the post, and have a judgement entered against you by default, i.e. not attending Court and defending the summons.

I doubt they will be a CCJ enforcement by then if you havent had a court date, if they do come to the door (which they probably wont, as they use scare tatics) just tell em to "GO AWAY in any manner you see fit, and that if they call again you will call the police for tresspassing and harrassment.
You will be fine, if they are ringing you a lot, consider changing your phone number (think you get one free change from BT) or get a new sim card (free from most Network companies).

Hi Richard - thank you. I'm definitely opening all my post as I want to see whats coming my way before it bites me on the bum!
Hi SD - thank you too. I've actually had no choice but to change number in the move so the phone calls are non-existant now. I've got mail re-direct too, so if they do pay me a visit, it'll be at the old house.
Am calming down now - as always after you guys offer advice. I'm holding it together but only just. Can't really settle into new place until this is all out of the way - am bricking it..... But, I will keep my chin up and I will get through this.
