the long and winding road.......advice

hello all...ive been quiet for a couple of weeks as i continue to try to plan my own demise whilst looking at any alternatives to BR..and guess where it got me?? more stressed...less sleep and back to ask for your opinions and help...i am going to go BR very soon..i am now adamant and just to refresh CCCS have advised me to do so.....before i do i am taking my ex partners name off the mortgage...i understand the OR may not look favourably on this but she left in oct 07 ( i can prove if required) and id have took it off it earlier other than fear of getting the transfer of equity through and arguably not wanting to accept shed gone.....so anyway..i am currently raising half the money to do this (200.00, can i justify this to the OR? im guessing not?) and raising the funds for my bankruptcy by not paying my non priority debt...i am setting up a coop cashminder today and am planning to get my wages and priority bills going out of that this month and going forward..is this ok to do pre bankruptcy, will the OR be ok about it?? im very stressed about a holiday i am schedlued to go on in september (already paid for)..i will need to take some money (all be it the money i would have spent on fuel / living whislt i was here if i didnt go) will the OR deem that unacceptable?? and my final bit..occasionally depending on performance our company issues bonus...this isnt a regular income as its only considered quarterly, i havent had one previosuly but i am due 700.00 this month..how will that effect the process if at all?? thanks in advance..would really appreciate a bit more guidance :confused:

    Hi,
    I'm sure someone more able to advise will be along shortly so I will just try to answer a couple of the "simpler" questions based on my own experience. :) It should be fine you opening a basic bank account prior to bankruptcy, particularly if you have an overdraft or owe the bank your account is with money. If this is the case they can take any money in your account and offset it against the debt (if I remember correctly) so opening a new account is a good idea.

    When did you pay for the holiday and how? Also when do you expect to go bankrupt and when is the £700 payment due? Could the two events be managed so maybe the bonus pays for the bankruptcy fees?

    thanks for the response december....paid just 300.00 for the holiday 2 months ago in cash...i envisage taking name off the mortgage to be 4-5 weeks process so after pay day this month when i receive bonus to pay for fees and leave me with money for month (29th august), around 2 weeks into september im expecting to declare myself BR

    have you contacted the Courts, they may have a long waiting list for appointments, or they may use a drop in system, its worth booking ahead if you have to (you can always cancel/rearrange your appointment if its not the right time).

    If you paid in cash for your holiday then the OR will not know that you're going if that makes sense. I think it only becomes an issue if you paid for the holiday using credit and then how much of an issue depends on the OR and whether you knew you were going to go bankrupt at the time of booking it. I would imagine it would only become an issue for you if the OR requested an interview whilst you are on holiday, in which case you could always pre-warn them that you would be unavailable for interview for these dates due to going on holiday. I wouldn't worry about it to be honest, but I know it's hard not to.

    thanks again shadow and december....i havent rang courts yet...once the name is off ill do that straight away...and your right it is hard..i dont want to have to hold things from the OR just adds so much pressure..ive actually lost my passport and have scrimped all this month to keep 97.00 to get a new one and am putting it against money allocated for living expenses/food...horriblew time but hey i got myself in this position so must take the rough...on the other foot...i canot wait ot spend some time with my son when i go away..hes 6 months....any advice on flying with young kids :o ??

    From what I've seen the guidance the OR's are given is that people should be allowed a modest holiday.

    thanks again both...in theory ill save 160.00 in fuel whilst im away as i work far from home...and if i take the money id normally spend on food etc over the 10 days i will have enough to get by so if its not necessary to mention i wont and if it is ill explain that justification and see if there ok with it..hopefully so.....does anyone have any advice on ex partners name coming off and my impending bonus? am i ok with that as long as i declare it? should i not spend it as itll need to go towards my bankruptcy?? thanks
