sneaky letter through door from Marston bailiffs

i hope you kind folks can help me. have been following MSE tips etc for a while, but first time i needed to post.

have just found a scary letter on my doormat which must have been very quietly slipped through my letterbox- i have been in a room next to it, and i didnt hear a thing!

how they got into the building is another matter, as we have an entryphone (note to self, check lock tomorrow.) to stop uninvited strangers getting in..

various reference number are quoted, but no details of the supposed creditor..?

i have one credit card a/c which is a much higher balance, with a claim for charges pending.. so i dont think its that.

they claim that 'despite previous notices and attendances' (?? first i have heard from them, and no one has knocked on the door, while we've been in anyway..), full payment is required or they will be removing my goods for sale at auction.

i am not keen on calling them this late, or indeed at all, in view of other threads about calling collectors etc..

for info, i am out of work and just receive benefits, with rent and c/tax covered. . anything of real value has already been sold off, to try and clear general bills.

the only items that MAY be worth taking left are this very old pc, and a tv which my mother bought as a present ages ago, though no receipt found-

thats my only 'pleasure', and i would hate to see that go, if only because i cant prove its not mine (i inderstand goods not owned by a debtor cannot be taken, but proof is needed??)


i have some queries-

do they have any legal power to force entry if i do not let them in, or if i am out, should they come back?

would they have to repair any damage?

what is best way to get more info, without accpting any iability..?

    They can only enter your property if invited in or if you leave a window or door unlocked - then they can come in as this is "peaceful entry".

    PM Herbie 21 if you can't find the answers from the weblink Georgeuk has posted. If you don;t know how to PM, then ask the Night Owls as they will help....(I will be logging off in a min.)

    It might be worth checking your credit report to see how the cc debt is being reported.

    BUT reagrdless, until you have the answers you seek and have spoken to Herbie:
    • do not ring them to discuss
    • do not open the door to them or leave windows open when you are in or out
    • do not leave your car anywhere near where you live (ie in the drive or shared car park etc)
    • do not enagage in any conversation (esepcially as it could be interpreted as though you accept liability for the debt...and after all it might not be you they are after.....)
    the only thing you ask them for if they turn up again (and through a locked door) is their registration number/certificate (get them to push the details under the door) so Herbie can check them out

    Sorry can't be more help but Herbie and her website are the best place to go.

    Good luck...and please don;t worry too much. These bailiffs are relying on you worrying..hence their actions/letters..all designed to intimidate.... so you don't think straight and open the door to them. If you look at previous posts/threads on here concerning bailiffs, the posters, with Herbie's help and advice (cos she's absolutely brill :T ) , live to tell the tale intact!!

  • right then- windows closed, door double locked. have got onto landlord about the outer door, which is going to get checked into.

    will i needa disguise when i got out, in case someone is casing the joint? haha.

    Do you have any CCJ's?

    I would check your credit file (free at experian if you cancel within 30 days) to see if there is anything on that which may let you know what the debt is for.

    Sorry I have only just looked at my messages......THANK YOU...WOL2 !!

    Many bailiff companies are now using delivery agents to post these notices through the door. That is why he would not have knocked!!

    Marston are a firm of certificated bailiffs...AND also a firm of High Court Enforcement Officers.

    They also have one of the three contracts with HMCS to enforce unpaid MAGISTRATE COURT FINES. These can be for a variety of offences to include using a TV without a licence, speeding, no tax or insurance.....or even using a mobile phone whilst driving. Could it be for any of these?

    Many times we find that a fine was imposed in your absence because documents had gone to a previous address. Could this be possible?

    Marston can also be pursuing you for an unpaid Parking Charge Notice (PCN) or unpaid council tax.

    If the debt relates to a High Court Enforcement, then this would be becuase you have been sued in the County Court and received a CCJ which the creditor wishes to enforce by way of the High Court. Did you know if a CCJ has been obtained against you?

    If this is an unpaid fine then there should be details of which court instructed Marston. This should give you a clue.

  • help today iv recived a removal notice from marston baliffs re non dom rates £1400.15 p im broke the bill is for a buisness that failed i have no income my x lives in the house i own with the children i have no car im not on benifits i have been doin od jobs im liveing at mums can the baliffs go into the house and take my x s goods ,the letter states that unless the debt is paid in full thay will atend with a locksmith to gain entry and remove goods please some advice
