Is bankruptcy the right option for me?

I am going to talk to them tonight. Yeah, I guess it is still repossession, its just that I thought you had to wait till they applied for repossession, I didnt know you could move it forward yourself. I dont know, I still think I should try and sell it. Its which to do first, I think we need to apply for BK and then see what the OR says about the house. Its whether the OR will allow me to move out on my own though? you know let me pay rent somewhere else...0

I think a payday loan is an advance on your wages? Really evil things because it must be so difficult to get back on an even keel after taking one of these, as come payday, some of your wages are already gone.BCSC Member 70:j

It is an advance on your wages, they take it on pay day then of course you cant afford it so you have to do another one. Does anyone know whether the OR would let me move into rented if my husband was still living in mortgaged property? thanks.0

Don't think the OR can stop you from living wherever you want...BCSC Member 70:j

Just wanted to say welcome.
I think a lot of us women(sorry to all the men on this forum:o )have got to that point when we just can not go on. Being the emotional creatures that we are,and the fact we do have raging hormones at times;) it's not suprising really.
It may seem like you have no fight left in you but you will find some extra inner strentgh to carry this through. You will get positive days and negative days louise but one thing is certain we will be here for both.
I could be wrong on this but if you do keep the house, then you have to be able to prove to the OR that you can make the mortgage payments and the secured loan payments. If the house is going(as in repossession) then the secured loan then becomes unsecure and can be included in your bc. Not seen it mentioned so thought i would add that.

hi louise in answer to your question what pushed me to bankruptcy.... they started pursueing me out of the blue after 12 years for the shortfall of my mortgage when it was repossessed about £17k i didnt have that money at all (just got back on my feet) i had no intentions of paying it to be honest as far as i was concerned i had brought up my 2 girls for the last 10 years on my own with no financial help from csa,i had cleared debts ex left me with had to really as they were things like gas ,electric etc (he was having an affair at work he spent the bills money on her i found out later to my expense)and it started to make me ill and after having one breakdown when ex left me i wasnt having another and going back down that road !! so i took advice and did it best thing i ever did hun honest !i am not proud of it at all and as far as people finding out my family and real friends i told as they all knew what i had been through with my ex and they backed me fully ! when it went in the paper i had one or 2 comments but just brushed them off (there are far worse you can do to get in papers!) funny thing was the people you would least expect to go bankrupt are the ones that have ,a local person i have known for years he approached me after mine and told me he had been made bankrupt too !! so the moral of the story hun is do whats best for you and your family sod other people its none of their bloody buisness to be honest !! any more you want to no just ask paula x0

Hi Paula! thats awful - after 12 years I thought there was a cut off for when they still could chase you
Thanks for sharing it all with me. Sounds like you have had a really tough time. I dont know how you have all got through it in one piece really, its all too much too take in. I think I would feel better if they were just my debts, but its all this added pressure with there being my husband to take into account. Everything just feels like its gone wrong. Bit heartbroken today I think x 0 -
hi louise you just get through it somehow esp if you have kids you have to they were the only reason for me living at the time ! but as my dad always says "if you got your health youve got everything " how true and it puts debt etc in to perspective ! i understand how you feel today but louise its ONLY MONEY AND BRICKS AND MORTAR ! (another of my dads wise sayings)life will go on you will pick up the pieces and carry on ,even though it doesnt feel like at the moment paula x0

Just got off the phone to the CCCS she was really nice. I competed their remedy about 6 mths ago and it suggested BK but I was so upset i tore up everything they sent me about it!! now after the initial shock and reading these forums for the last few months I am realising that might be my only way of getting a normal life back. I just hope my dad doesnt find out. He is so depressed at the moment after being made redundant a year or so again, he was never the same. He just mopes round the house. If he finds out it will kill him, he will be so disappointed at me and he will go nuts at my hubby, because he has always said he doesnt support me enough! argh! oh anyway, as i didnt have the reference number for the remedy anymore - i have just done it again. it came out with the same advice - go BK. So i now need to speak to their web team people. After reading their information pack they said you cant keep your HP agreement going - i.e i will loose my car. upset about this, as i have nearly finished paying for it as well. its worth 2 grand so i guess i will be loosing my hubby, my flat and my car
they wont take my 14 year old fatty kitty will they
hehe! watch em try! x 0 -
Thanks Paula - your dad sounds very wise
I havent got any babies no, just the cat - she is my baby. Desperately wanted children but I have been told 2 years ago chances are slim. That didnt help neither. Not had much luck really! thanks for all your advice x 0
