Thanks for your comments, I have spoken with N power again today who advised that we are using 25 units per day which is average for a house with 2 adults and 2 teenagers as they are classed as adults, therefore can not reduce my bill at the moment know this includes 1 or 2 missed payments from the beginning of the year. I will try to do a new soa reducing some of the out goings but things like sky we if cancel this then we cann't receive any reception from the aerial so no t.v, mobiles I have spoke with vodafone we are in a contract until next yr and reduced to minimum they will allow. My worry is that mortgage going upto £830 on interest only we need this to be on repayment which will then be over £1,000 when my OH goes back to work trying to go every day but still very sick, we will end up in court no matter what because RBS for the unsecured loan will ask for CCJ forthwith unless we can find £20,000 within 28days this will go ahead I am advised by their sols.

    Many Thanks

I have looked at reducing broadband to £10 per month a sky reducing by a further £10 so that saving me £18.00 cann't do anything with regards to council tax, gas, electric, water, landline as these are on the minimum they will accept. Cann't rent a room no extra space, son looking to get a part time job at lease I won't have to worry about clothing him youngest son to young to work.

    Many Thanks

Well done on making those reductions.

I am very worried about your previous post. You must challenge the CCJ, get it tranferred to the local court and provide a SOA to get a reduced monthly payment.

Unfortunately, you will need to show that you are living within your income, which is not what is happening at the moment, so getting that into line is going to be essential if you want a monthly payment rather than a forthwith judgement.

Thanks for your comments I have spoken again with sols today they have still not received instructions to acr from RBS, spoke to them to see if I borrow money and clear arrears of £600 will them revert back to monthly payment, they won't do this reduced term from 13yrs to 5 yrs which means they are looking for a payment of £417 per month so its probably just as well that they won't accept this offer of clearing arrears as when mortgage goes up I on't be able to afford the £200 let alone the £417 per month I have been speaking with NDL who advised me not to worry the court will only apply what we can afford, once the paperwork has been issued we will ask for this to be transferred to our local court. We have never been behind with payments before but to illness beyond our controleven though we took insurance which has now finished for the mortgage payment we are still pay £35 for cover and cann't be provided until OH back at work for 6 months, also some of the credit we had insurance but won't pay out for existing illness even though when we took these out he was not ill, illness related to period of illness 12 yrs ago so they say it pre-existing what a cheek didn't have any trouble selling this to us at the time.

    Many Thanks

    Hi

have you reclaimed the PPI insurance that you were plainly mis-sold? See here http://www.moneysavingexpert.com/reclaim/ppi-loan-insurance

The OFT have made it quite clear that most of these were mis-sold. Unless it was made clear that it was optional and took into caccount your OH previous history, you should get the money back.

The CCA should be returned within 12 working days plus two days for postage. Another 30 calendar days after that they commit a crime if they try to pursue you, although no one has eve been done for it. They would however have to produce the CCA in court to be allowed to proceed with the hearing.

However, if they subsequently produce the CCA, even after the time period is up, then the debt becomes enforceable.
