BR and council tenancy?

Can someone tell me if your council home tenancy is affected by going bankrupt?
I have 4 children, and have debts i cannot pay- i am gradually working my way through all the BR helpful messages on here ( Thank you!) but can't find anything about this.

Are the council likely to want to re-house me somewhere cheaper in rent( I may well be on IS by then, with the kids and live in a 3 bedroom home) or as the rent would be helped by housing benefit- does it affect this?:confused:

I feel BR is the obly option i have- but can't run the risk of losing our home as I'd be on my own with the children.

  • I'm in a housing association property which I was referred to by the council. I had thought that bc my BR will include rent arrears that I would either 1) have to not include them in my BR 2) I would be evicted

    The actual advice I got from the lady from my HA was "declare your rent! We cant evict you. Never would, never could"

    This is my HA / council though so I suggest you double check with yours. Email... its anonymous :) Thats what I did.

    Just re-read ur post and u dont mention anything about rent arrears anyhow so I think you have nothing to worry about all all...
    Debts incurred through illness and homelessness, starting a degree in September, going bankrupt in November and having a well deserved fresh start in January 2009! Bring on the new year! Interested in thrifty living, and if its green all the better for it! xxx

    My HA weren't bothered that I was bankrupt at all. My tenency has continues as normal and I continue to pay by direct debit. Although I was not in arrears with my rent, are you?

    If you are at all worried an anonymous call to your council will tell you what their stand on it is.

    Just to add another question- my daughter has been saving up for a laptop for Uni in my savings account so she didn't spend it- should she take the money out now before i start anything- or will the courts etc wonder why there was a sudden full withdrawal.. or is it usual for people to empty accounts pre- Br?

    The courts may wonder why there was a sudden withdrawal, but there may be light at the end of the tunnel, have you got a paper trail to prove this, ie did you daughter pay by cheque?,

    I am in a housing association house and my landlord is not interested in my bankruptcy I had a little arrears but did not declare them in the bankruptcy and I have cleared them. As long as I pay and continue to pay rent I am ok.
    Best to check but as you have no arrears I'm sure there will be no problem.

    I would take all the money out of your savings as it could be frozen and taken by the bankruptcy I would give it to your daughter and ask her to sign a letter explaining why the money was in your account not hers to give to the bankruptcy if needed at a later date.

    She didn't pay by cheque- just part of her weekly savings each month, and i was worried they'd take her money- as with all this going on i can't affors to kit her out for Uni either.

    yes take the money out most bank accounts get frozen and you could loose what is in them. Take it out noe at least it is one less thing to worry about.

    We are private housing tenants and there is no clause in our tenancy regarding bankruptcy. Apparently the OR needs a copy ofyour tenancy agreement and again apparently may informyour landlord. My sister is BK (now discharged) and is a council tenant in Birmingham and this was never a problem for her. Just check your tenancy agreement.

    Councils are social landlords and wil not evict you if BR.
