I need help and if there is anyone out there that can advise me that would be great.
I have purchased a car on hire purchase from Welcome finance, and i went bankrupt in feb and the car is sitting on my drive at home. I have contact welcome in a number of occasions and they dont seem interested regarding the car. The Mot and the car tax has run out and my partner is going mad that a perfectly good car is in the Drive and they dont seem interested in it and we can not use it. I was thinking getting the car back on the road but i dont know where i stand. I must admit im thinking about selling it and i ownder if there is anyone out that can give advise what to do?
cheers

i know i cant sell it but they do not seen interested, and i have not reg to say its off the road as i though Welcome would come and pick the car up and i now have a penalty for not letting them know.i was told by welcome back in March, April ,May and june they were picking the car up as a urgent pick and its still there . My Mrs is going MAD!!!!!... Is there anything i can do regarding this. As the debt was not included in my bankrupcy due to the fact it was a hire purchase.0

Just double check your agreemant is HP and not a Personal loan dressed up as HP.
there has been a few threads re welcome being like this which is odd as if its HP you would think they would take it double quick, and i have seen a post or too that have made me wonder if they are actually HP agreemants.
Does it state loan secured on car etc and that after say a third to half way into the agreemant they cant repo without a court order and also at about the same point you can returnn the car? if not it may not be HPThats it, i am done, Blind-as-a-Bat has left the forum, for good this time, there is no way I can recover this account, as the password was random, and not recorded, and the email used no longer exits, nor can be recovered to recover the account, goodbye all ………….

Get your OR to phone and say vehicle uninsured - most HP companies then pick up very quickly

I would write Welcome a letter giving the date that you first asked them to collect the car.
I would then advise them that as the vehicle has been taking up space on your driveway you are charging them say £25 per day storage charges and the amount they currently owe you to date of letter is £.....
Ask them to contact you by phone urgently to arrange payment of the storage charges prior to collection of the vehicle.0 -
When i went to court the OR said that the car could nbot be part of the bankrupcy, they just dont seem bothered with the car. My contract did state that if i did not keep up with payments they would take the car. My last payment was 9 months ago in Dec 07.
i just dont know what to do!0 -
Hi Mr T
Get some legal advice - speak to Community Legal Advice Direct on 0800 9750026. I'm sure I read somewhere (but please, don't take my word for it!) that when you've asked the companny to collect their goods and after a 'reasonable time' they haven't done so, they become yours by default. I could be wrong though, so give CLA a ring - it's free, government run and really helpful!
Good luck
