Help What Do I Do

I recieved a letter today from mackenzie hall looking for me (using my maiden name) so i was dubious as i have been married for 4 years.

i phoned them on the number stated they asked me if i was xxx and i said no because i havent been that person foro a long time. they said did your name used to be xxx i said yes can i confirm the address i said 'the address on the letter is xxxx '

they then told me this is about hsbc account which i forgot about ages ago saying i owe £500+

will i be paying it? i said no as it was statute barred as it was from about 7 years ago and he said i wasnt statue barred as the account wasnt closed till august this year.

is he right what should i do?

    Mackenzie Hall are talking out of their backsides, which is perfectly normal for them. ;)

    It doesn't matter in the slightest when the bank closed the account. That is irrelevant for determining whether the debt is statute barred.

    From a previous thread:
    A debt will be "Statute Barred" if there has been no acknowledgement of the debt by you making a payment or in writing within the relevant limitation period.

    If you are in England/Wales then the limitation period is 6 years and you should read:

    If you are in Scotland then the limitation period is 5 years and you should read:

    If you feel the debt is "Statute Barred", then there is a letter to write at the end of each factsheet.

  • what should i do with regards to the action they have threatened?

    hiya hun I think that if you click the factsheets fermi has linked then send them the letter attached you should be fine and if they should then do asnythig such as send bailiffs out then i believe they are breaking the law. make sure you send your letters recorded.
    You never know how strong you are until being strong is the only choice you have.

    Hi hun, dont worry about this, Fermi knows everything there is to know about this. Follow advice and you will be ok hun. They are talking bowlarks. Dont lose sleep over it, And dont ring them again. And dont worry about bailiffs. DCA have as much clout as a chocolate fireguard xxxxxxxxxxx

    blumin eck,what a bunch of numpties,take no notice,but dont ring them,copy all correspondence and send everything recorded and keep reciepts etc,cover your ar*e while they chat out of theirs,:rotfl: hope they soon realise their mistake and leave you alone but in the meantime stay strong and know that your in the right and your legally sat with the upper hand.xxx
