  • Thanks Fermi, yes can't see how they can win this one, the debt was included in the list - although it has gone up a bit since then, especially now with solicitors fees and court add-ons.

    They can't win in the long term since the debt is legally included in you bankruptcy whatever happens, and it doesn't matter what they try to add on.

    What we really want to stop happening is the court making a judgement for these people in error. It has happened before.

    Because of the bankruptcy you could get it struck out if they did, but that will involve so much more hassle. Best to get the action squished beforehand.;)

    GH stick to you guns once they realise they are on an hiding to nothing they aint going to waste money following up on this.

    My Advice would be to give CAB and the OR a call before you do anything

    No I didn't contact the solicitors - I'll give them a ring tomorrow.

    Oops! I read that as "you HAD contacted them" when I went through this earlier.

    If they have any sense, then they will withdraw with no more fuss once you have given them details of the BR.

    But talk to your OR as well, and keep the other options in mind just in case. ;)

    I've had about 4-5 CCJ's entered AFTER BR even though I contacted creditors, creditors' solicitors and the Court. OR had contacted creditors too. The OR will sort it all out but still its a mess

    Thanks Fermi, I'm not too familiar with the names & numbers of forms.

    GH, there should be a number and password on the top right hand side of the front page. You can go online and enter your defence, this being that as you are bankrupt, the debt is unenforecable and that you defend the whole amount. There is no fee for this. If for any reason you can't do it online just hand write the forms and send them to the court.

    The court will then pass this info onto the solicitors and they will drop the case. If for any reason they don't it will be kicked out of court on the day.

    DO NOT give it to the OR to sort out, chances are they won't do in time and it'll be a whole heap more hassle trying to get the CCJ removed once judgement has been made.
