Well I've just sent my letter to both Courts today, def not going to be able to attend one as its nowhere near where i live and have asked them to move it. Spoke to one of the creditors who have informed me that there intension is not to take my house from me merely secure the debt so long as I continue with payments. So i'm happy to proceed with that I suppose have no intention of selling up any time soon unless I absolutely have to so they'll have a long wait. These companies make me really cross as you try to do everything by the book, keep them informed, make token payments etc what more can you do when you hit difficulties?? Will let you know outcome of court/letters next week. Fingers crossed!Remember ....its not a bargain unless you need it0

I have been speaking with payplan and NDL,if they grant a charging order she said we should ask for conditions, not to sell property until youngest child as left university, my husband is ill or until he is better, is there a time scale or will the sit for ever waiting0

I read a post on here somewhere that a CO can only be on your property for 12 years, dont know if that is correct or not.
Both of mine have been adjourned following the letter I sent to the Court.
Let us know how you go on 16th Mrs P.Remember ....its not a bargain unless you need it0 -

I had a CCJ against me with RBS. I paid the asked for £75 the first month and they immediately returned the payment, then I received a letter saying they had applied for a redetermination. That came and went, I didn't realize that I should have attended and received a letter demanding £27,000 within 14 days as I did not attend. I wrote to the judge explaining that I didn't realize I had to attend and explained my financial situation and applied for a redetermination myself. In the meatime I received an interim charging order and a court date from RBS for a CHarging ORder on my property. They had lied in the application saying that I had only one unsecured debt when I have about 7/8. I wrote a long letter to the judge explaining once again my financial situation, that they had in fact lied about my other debts that NAtionide had already applied for a charging order on my home for a £2400 credit card debt (they never even took my debt to a debt collector took it straight to CCJ demanding £105 per month)which I obviously could not afford to pay and then went to Charging Order which I didn't defend.)
Anyway, having waited 3 long weeks to find out what happened as I could not attend the case hearing I received this today:
Upon neither party attending.
It is ordered that:-
1.Application for redetermination dismissed.
2. Application for final charging order struck out.
3. Interim charging order discharged.
4. No order for costs
Anyone ever had this happen to them? I called CCCS and the man there said Well Done! They may come back but chances are they will know that they really upset that judge by just not turning up when they brought the case to court.
Still not sure whether this is something to get excited about or whether they we just pop up again in a few months and put me through it all over again!!!
If anyone here has a legal background and understand what this actually means I would be grateful to hear it!Cabot Finance (Barclaycard) £3391, Capital One - £3237, GE Money Loan - £710, O/D - £3000

They were asking the court to order higher payments - judge said no
2. Application for final charging order struck out.
3. Interim charging order discharged.
The application for a charging order has two stages:
Interum Order - The bank requests a charging order and the interum order is granted when the court is satisfied that you own the property.
Final Chargin Order - The court will decide whether to make a charge against your property.
Again judge said - not going to happen
4. No order for costs
You don't need to pay any court costs or costs due to CCJ not being paid
I think now that this decision has been reached, you can just carry on paying the original judgement amount. So i'd say  as you still need to pay the CCJ.After falling off the gambling wagon (twice): £33,600 (24,000+ 9,600) - Original CC Debt: £7,885.91
