For 3 years I was on a DMP with CCCS and was going well until after the birth of my son (now 9 month so no mat pay). As there is no way we can afford childcare for us both to work I have now no employment. This left me with no income other than Child benefit and so CCCS had to cancel DMP as they can not accept child benefit as it is for the benefit of my 2 children.
I owe £32,000 to creditors and have been advised to make token £1 payments. As I do not know when I will be in a position to work I dont know when I can increase payments (my husband works away in order to meet the "normal" household bills and rent, and we have no real assets. What do others think? Also if I do apply for bankruptcy (if creditors dont get there first) does my husband have to do so too (HE HAS NO DEBTS IN HIS NAME!) how would me going bankrupt affect him?
ANY advice would be great, thought I had this all sorted with CCCS but they never made me aware about child benefit even though they used to take it as income.

Bankruptcy is an individual thing so there is no need for your husband to go bankrupt if he has no debts and none of yours are joint.
When you fill out the forms you have to put what your husband contributes to the household but that's about as far as it will affect him. I'm single so don;t have much first hand knowledge of going bankrupt whilst in a relationship but a lot on here have and will be able to advise
