Default dates and taking Data Controller to Court?

I was made discharged from Bankruptcy Aug 07. Having applied for basic accounts and been rejected I queried the credit reference agencies which originally showed nothing untoward (other than bankruptcy!). Anyway a link with my old house shows a default with Lloyds bank still outstanding. Having read a great link on here I wrote to the Data Controller for Lloyds in May 08 to say that the default date is AFTER my bankruptcy and therefore incorrect - should be showing as "satisfied". I waited well over a month for a response but to date haven't received one. I therefore sent a complaint to the information Commissioners office beginning of June and just received a letter from them giving me a case file number. Having rang them, they said I would have to wait another 3 months for a responce and suggested I took them to court. Can anyone advise me on doing this - the process seems to be taking forever and in the meantime I can not get any account opened - all my wages are going into an old savings account! Help anyone?.......
