National Insurance CCJ advice.

Hi All,
I am after some advice, or a way forward.
I have recently finished an IVA which was removed from my credit file in May 2008, so I waited for my credit file to be updated, ordered one and it was clear for the first time in 6 years.
I decided to changed banks so applied for a first direct account, and got rejected. They were very helpful and explianed even thought my credit report was clear, there must be something on my previous address, as experian said there was something on my file....
This is where it gets interesting, after a chat with exprian, it turns out they only send you, your file on the address you asked for, even though it lists all your address.
Experian sent me a report, the new report showed a CCJ from 2006, for an address I moved out of in 2002. The CCJ was issued by the Inland Revenue (National Insurance debt departmant).
So I called them, it turns out the National Insurance is not updated if you move, unlike the Tax office does. They graciously aggreed to wipe my debt off as I was insolvent at the time, but I had to pay £40 court charge. This I did grudingly, they said I was clear, and I could conact the court.
I called the court again, and they said I could could get the judgement set aside, but it would cost me £75. This I am not happy about paying, as I have settled with the IR.
What can I do, as the IR said they would not contact the court, to have the CCJ removed, as it was my fault that I did not update my address with them (I never knew I had to)?
Any suggestions, as I really do not wan to pay the £75, and I am annoyed with myself for paying the £40, as I was insolvent at the time, and the Inland Revenue was one of my creditors, and knew about my IVA, just the do not share information between the departments.

It IS the right board, Marky - but it is not a situation that many of us will have encountered. I was actually declared bankrupt, by HMRC, which, effectively, wrote off my NHI debt. I thought this was also the case with an IVA - but obviously not in your case.
Personally I would advise talking to your local CAB or the UK Insolvency Helpline - 0800 074 6918, who may be able to clarify your situation.

You say it was issued in 2002? If you have paid the amount that they require, then you need to get who you paid the money to to send you a letter stating it has been satisfied.
You can then send that to the Court who should mark it as satisfied.
If the CCJ was issued in 2002 it should come off of your credit report this year (6 years from date of CCJ issue).

The CCJ for my IVA came off this year, so that and all my defaults have been removed.
The CCJ from the IR was put on in 2006, so that will come off in 2012.
I could pay the £75 to the court, to get the IR CCJ set aside, but I don't really want to, as I don't belive it was my fault that the CCJ was put on. I was insolvent at the time.

Was the 'debt' for which the CCJ was obtained, incurred before you started your IVA, or whilst you were in your IVA?
If it was incurred before you entered into your IVA, then you should talk with your Insolvency Practitioner.

Ah right I see.
Yep the £75 is "justified" by the Court. To be honest it would be a small price to pay for the CCJ to be removed if it is stopping you for the next 4 years.

The NI debt was incured before my IVA.
I have just got of the phone to one of the NI customer service managers. They are going to set aside the CCJ, and ask the court to remove it from my credit file.
I am happy now.Frustrated in Shropshire....0
