  • Interesteing to see so many replies along the same lines. We went to court and quoted the case given by so many. We were also advised (wrongly) to apply to have the judgement set aside. We wasted £70 and a lot of time. Advice came from NDL and a solicitor (free advice via telephone from a local friendly chap)The details of everything relating to this case are a bit hazy now and I have tried to put it behind me. The debt was only £1800 so it will be paid soon. The Marlin one is £10k however!!

    The judge was really unpleasant, looking right down his nose at us and didn't actually give us a lot of opportunity to speak. The system really let us down and we don't hold out much hope just now that there is anything we can do. I am sick of trying to get advice over the phone as I don't always think they get all the detail and I certainly miss points. CAB won't deal with us as I am self employed.

    Life looks pretty crap just now. I don't even want to get a DMP as it messes up the bank accounts and I have a business account with the bank i owe the most to!!! We have almost no equity, two ccjs, one charging order and £60k debt. The Marlin debt is a ccj which we have been paying but we have just been notified that the case has been "transferred for enforcement". Great!

    A lot of the problem with the way these court issues pan out is to do with the actual judge that you get on the day.

    I do a fair bit of court work and I pretty much know now how the day will be as soon as I see the name of the judge.

    So please don't give up on advice centres like National debtline and don't give up on help from the court. OK, you got an unpleasant judge last time and there are many like that. There are also some that will listen carefully to both sides and be very fair.

    Please keep posting on the Marlin debt. They seem to have bought up a huge amount of debt recently and we all ned to share experiences of dealing with them.

    As you can tell, we are a bit cheesed off with the whole situation. We have tried so hard to be proactive about sorting out our finances but everytime we think we've settled into a repayment scheme we can manage something like this happens!!

    Anybody out there know what the public can do if they are not happy with the way they are dealt with by the court? Complaints do not cover the actions of the judge. Is it only people with pots of cash who can fight back when it goes pear shaped?

    where does that leave the rest of us? Bitter thats where!!! I'm beginning to see why peolple do loony things to try and get some support and a reaction.

    As for Marlin, the more I read the more I am concerned that they are shysters. Surely there is something that can be done.

    As far as Marlin are concerned, they are at the bottom of the food chain. Like the rest of them, they are total scum bags! Sorry, just had to add my penny's worth (it would be tuppence worth but I've just paid my car tax!)

    I can't believe that so many judges are granting CO's. The whole point of an unsecured loan is that it is unsecured. Is it because of the credit crunch? or are judges just particularly nasty? If I'd known that my house would be at risk when I took out credit cards, I would never have done it. It does seem that even uneforceable CCA's don't seem to matter. CO's will still get granted. Sorry, just having a bit of a rant about this.

    Debt 30k in 2008.:eek::o Cleared all my debt in 2013 and loving being debt free :)
    Mortgage free since 2014 :)
  • If your home is jointly owned and debts are in one, or other name (i.e. not joint) could you transfer the home into the name of the person with no debts?

    You would have to do this before any CCJ's went through though, and you would need to have a REALLY trusting relationship with your partner!

    If any collectors then went for a CO they couldn't get the caution applied at the land registry surely?

    Just a thought really?

    Hi, Been Going Through Here Trying To Find Out More About Marlin As I Too Have A Debt With Them That Presumably They Bought. I Have Now Written To Them 5 Times With Offers Of Payment And Thay Just Wont Compromise And Are Now Threatening Court Action. What I Have Read On Your Thread Just Scares Me All The More.
