bankruptcy advice needed

i am considering bc due to having 16k+ in debts (catalogues, cc, loans, ct)

i am a single mother on income support, child tax crediit, and child benefit. husband left nov 07

i live in council rented accomodation.

1, my debts were caused by living beyond my means. and sone dating back to when i was 18 and credit was too freely offered to me

will this seem that i was irrisponsible and caused my debts and that bc may be refused?

2, bailifs have a walking possession order on my items due to unpaid council tax which i am paying at 20.00 a week, and is due to be paid back by xmas

will this cause problems or should i wait till i have paid back the money and walking possession is released?

3, i have use of a metro, worth 300.00 but is in my ex husbands name, will this be affected?

4, most of my furniture is on hire purchase from brighthouse and buy as you view, how will this be affected? if taken i will be left with no cooker, sofa, tv, bed, walldrobes etc

4, i have been ignoring letters and calls now for 2 years, will this be seen as detrimental to me? i was depressed and couldnt cope but now want to regain control

5, a few years ago i was on £1.00 monthly payments organised by the CAB but was still chased for more by the companies even though they accepted the 1.00. this caused the depression hence the ignoring of corrispondance

any advice would be appreachiated.

    will this seem that i was irrisponsible and caused my debts and that bc may be refused? No, not at all, the judge will have seen this happen many many times before ad would not refuse to bankrupt you.

    2, bailifs have a walking possession order on my items due to unpaid council tax which i am paying at 20.00 a week, and is due to be paid back by xmas

    will this cause problems or should i wait till i have paid back the money and walking possession is released? The council tax arrears will go into your nakruptcy so you won't have to pay the bailiffs anymore, although getting this through to them may prove difficult!

    3, i have use of a metro, worth 300.00 but is in my ex husbands name, will this be affected? No, it's not yours. But you will have to fill in the part of the form which asks if you have use of a vehicle which belongs to somone else. You can then put petrol down on your expenses

    Hi e, don't worry, so many people have found themselves in the same position as you, you're not the 1st and you certainly won't be the last. The majority of people who will be dealing with you at the court and the OR's office will treat you well and will not make you feel bad for the situation you have found yourself in.

    First off you really need to talk to CCCS, national debtline or the CAB regarding bankruptcy as sometimes the judge can ask if you've taken professional advice.

    It is very rare (i haven't heard of it) for BR to be refused due to "irresponsible" behaviour.. the worst that can happen really is that you'll get a BRU applied which will prolong the conditions of BR. This is unlikely though as usually applied when the debt is caused by excessive gambling etc

    I think that this will be included in your bankruptcy order... not 100% on this as not sure how walking possession orders work but would guess it wouldn't be treated differently, someone more knowledgable can answer that one :)

    If it isn't your car then it won't be a problem (assuming it was bought by your ex and is in his name?) .. there is a section where you can put if you have "use" of someone elses car.

    No sure how this will work as they are on HP but have you looked at your local freecycle for domestic things?

    It took me two years from first being advised to go bankrupt til when i actually did it .. was ignoring letters etc .. the OR does usually understand how easy it is for people to try and ignore the problem.. are all your debts old? if so you won't have any probs at all (all mine were two years old and my OR said it made it very straight forward!)
