Bankruptcy time line

Hi all
Going down the bankruptcy route Can anyone advise on timing once things start rolling. We are moving into a rented property next weekend and won't have cash to petition until start of September. Forms are all complete and had an insolvency practitioner (friend of friend) check them over for us. Once we pay this to the court how long do you have to wait for a date to actually go to court

    HI Jan

    Welcome to the board.

Depends where you live really, I have all forms ready but there is a back log at Crewe. So taking about 6-10 wks from going on list to getting date.

You pay the fees on the day you attend court.

Stop paying all creditors except elec gas water c.tax & rent. This will help you save fees.

Someone will be along shortly whos more experienced but wanted to give what I know.

  • In my area there is only a two day waiting for an appointment for the court appearance for BR. I know some people here have to wait a month or more on here and some have a court where you can just walk in. Best to ring the court and find out their timescales/arrangements.

After the court appearance I had a brief word with the OR dept, a further conversation 2 days later when they told me what additional info was required. Then 2 weeks later the full OR interview.

That was a month ago. I have since had another short call for further paperwork, and a letter to say I could keep the car. So so far 6 and a half weeks and waiting now for enquiries to finalise.

    All the best.

Can anyone confirm when you actually pay the money? Is it when you go to the court for them to go through the forms or is it actually when you see the OR? Are you given a date when they inspect the house? Is everyone inspected? Son still lives with us, would his possessions be taken into account - would he have to provide proof that they were his and not ours?

In the vast majority of cases you pay the fees to the court on the day of the hearing.

Your home is not inspected by the OR.

  • Son's possessions are his own (as you say "still" he sounds like an adult, but probably no different if a minor). You wouldn't need to include them in the SAE as OR has no rights to these.
