Letter from creditors, what does it mean?

Please could someone advise me.
I posted a thread recently regarding our debts (you can find it here http://forums.moneysavingexpert.com/showthread.html?t=100342)

I have today received a letter from this particular creditor (littlewoods index), but i'm not sure what it means. Heres what it says -

Dear ***,

With reference to your letter dated 10th Oct. I can confirm that we will not be pursuing the above Littlewoods account for the outstanding balance of £1340.97.

As the debt remains unsatisfied this will be noted on our internal files for future reference.
This information will also form part of your records at the credit reference agencies.
Yours faithfully,

Littlewoods finance company.

Would someone in the know please be able to tell me what this letter means, and do i still have to keep paying the debt collections agency?

I dont know what to do next.

  • No the debt is now legally settled,

if you receive any further Contact from the DCA’s forward them a letter including a copy of your letter from littlewoods and ask them to cease all further action

    Yes

However it will stay on your credit file as "Unsatisfied" however if you file is shot already this is of little concern

    yes it does
you don't have to pay them
i had 1 just the same they had no credit agreement so can't enforce the debt.
it will be noted on your creditfiles though i think as unsettled but will drop off after 6 years.
i am going to make an offer on mine of about £300 and ask them to mark account as settled and credit file

it is totaly up to you whether you want to settle it or just leave it.

WOW, I didnt know they did that I've never heard of it before!
So, has the collections agency just been stringing me along and i shouldt have been paying them?
Also what do i do if the collections agency says they're taking me to court if i dont pay them?

Yes, they will try and milk every last penny out of whoever they can !

I doubt that after you inform them of the letter from littlewoods that you will ever hear from them again, they know full well they have no recourse with you now so wont waste their time & money chasing you.

if / When they do contact you, make sure you write to them via recorded stating that the debt has been confirmed as unenforceable under S 78 of the CCA and that any further contact by themselves will be considered as undue harassment and reported to the relevant statutory authorities

Make a few copies of that letter and keep the original safe. You owe nothing to these people now but you might need to prove it at some point in the future.

    Here to Help !

There is a lot of debate here at the moment about responsibility’s for debt, and debt avoidance, however in your case I think we can see that you have learnt the hard way like most of the people on here.

    Good luck for the Future
