    It doesn't really matter whether you or the company believe you to be self employed or employed - it matters what the Revenue think.

    In your situation it seems that you don't need to worry about the three months deadline for registering as self employed so if I were in your position I would phone the tax line in the link in my previous post and ask for their advice. I would probably say something like...my employers have advised me to register as self employed but I think I may be employed, and then take it from there.

    Don't forget though that if any of your other jobs are self employed then you should have been registered as self employed within 3 months of starting them.

    I believe that as you've been with that company for less than a year, you are likely to have no rights as an employee either (unless dismissal was due to race or disability), but I'm not 100% sure of that. If I am right then this means that you will gain no benefit from pursuing whether you are employed or self employed but you may have the satisfaction of seeing the company you worked for 'punished'.

    It is a confusing area which is why it's best not to worry about it yourself - the choice for you at the moment is 1. to let it go or 2. speak to the tax office.

    And I DID have a contract with this company if you didn't notice the fact that I kind of mentioned it in my first post and as far as I'm concerned having a contract means I DO have rights since most people with contracts are known as "employees" if I'm not mistaken although the company called us self-employed just because of the tax thing.. Besides, this was not my OWN business. I was not in charge of this company or anything. I was treated like an "employee" EXCEPT for tax. That's it.

    I don't think it was particularly nasty; it was just a cheap joke, and exactly what I thought TBH.

    The OP has essentially been working for a premium rate telephone service. I doubt that any sensible person "believes" in Tarot.

    It does sound as if the Inland Revenue might possibly consider you an employee.

    Did you work the same hours every day?

    Whilst you have a good attitude, in being prepared to let it go, it would be satisfying to stitch them up, wouldn't it? If the Inland Revenue decided you were an employee, you might well have a case for breach of contract or something like that if they did not follow their own disciplinary procedure. Ring the Revenue and check!

    And as for personal beliefs that is a whole different subject. A person's sensibility has nothing to do with it. It is merely faith, open-mindedness and understanding.
    Although quite honestly I couldn't really care less what you think anyway.

    Finally, someone less nasty and more reasonable replied to this thread. Thank you for the info although I have decided to let go of this case for now. Better not waste my nerves on this anymore and just accept the fact that life sucks sometimes and people can be real a-holes to you.
