county court reply forms question please help

hi i am fillin in county court forms for a claim against me

where do i send the reply it says on form to address to where documents to be sent which is to the claimaint solicitors,

i am admitting the claim and sending in a means statement so i can pay by installments,

i woulda thoguht it would go to the court how does it work is it upto the claimant if they except ????

quick replys appreciated as i need to send of in the morning

  • if you are accepting liability and offering payment there should be no need for the matter to go to court ?

    If you do go to court then the Judge will review your I&E and rule according to what you can realistically afford.

    Perhaps if you give some more details on the debt then I can advise further

    its a hsbc business account debt,

    i recieved summons from northampton county court,

    from intrum justitia's solicitors,

    i have filled in the form admiting the claim and with offer of payment if i send this back to there solicitors and they agree payment does the ccj still get entered against me

    what if there solicitors refuse my offer or cant they

  • under the extended use of Pre Action Protocols they are obliged to accept "reasonable offers" this is directly proportionally to your I&E.

    If they pursue the matter to court even after you have mad a reasonable offer then this will not be viewed favourably by a judge.

  • Send it back to the creditor if you agree to the claim if they don;t accept the court will make a judgement based on what you have filled in.

    Make sure you return it within 14 days.
