thanks peb..id have thought (just my opinion) that in the current environment theyd be more likely too??
im in negative equity? im paying every month? why would they want to lose custom and take on additional debt? if i wasnt paying each month i cud understand but still...i dont know just my meandering thoughts..
and would they know i was bankrupt if i continued to pay??

i plan to go br in a couple of weeks...one of my debts is to my father...i plan to use some of the cash i take out of my account to live on prior to bankruptcy to give to him to pay a loan ive been paying monthly in his name..the plan being if i cant afford it intially following bankruptcy hes covered....can i do this?? is this seen as fraudulent?? if i cant pay more can i just pay the monthly amount until i become BR or is this seen as favouring a creditor??0 -
It will be seen as favouring a creditor and will not be looked on kindly by the OR. He will try to get the money back from your father and could look more deeply into your affairs.
Your father will become one of your creditors in BR and you officiaally will not be able to pay him. But what you do with your surplus or use any rejigged finances after BR is up to you.BSCno.87The only stupid question is an unasked oneLoving life as a Kernow Hippy0 -

so in summary the money i take out of my account prior to bankruptcy to have as cash for living must all be accounted for?? i couldnt slide any out of that or id get in trouble with or??0 -
Well if you need to do your monthly shop the OR wouldn't be looking at your reciepts to see that you actualy did spend £190 per month on groceries

on a serious note...should i log what i spend my cash for living that ive took out on in case the OR asks ?? ill try and add small amounts onto each note to cover my dads bill...:rolleyes:0 -

I shouldn't worry to much about noting everything down. As long as your expenditure is not excessive and matches roughly what your I&E ends up being you should be fine.
And Martin Lewis is definatly a legend
