Threats Of Issuing A Sd.

HI, have three debts , with on going CCA requests . Receiving threats of the issue of statuary demands. My question is should I let it go ahead ? I have no disposable assets and I am on a low income. My partner is sole owner of her house . I had to sign a agreement before mortgage was agreed , that I had no financial interest in or claim on her property . As I am disputing the agreements on my debts I have not made any payments for several months. I can not afford to petition for my own bankruptcy , but need to make a fresh start .

It costs a creditor `£1200 to £1500 to make you BR so it is highly unlikely they will do it.

The most likely to are HMRC, American Express and Council Tax.

But saying all that it may be worth having a chat with National Debtline about your situation.

  • SD cost little or nothing to send so are frequently used but rarely followed up

However if you recieve one you should not egnore it, seek advise from one of the debt charities and follow there advice

However if you have issued a CCA correctly and have the proof, you have a perfect defence as no action should be taken until they have complied with the CCA request.

It is highly unlikely they will make you BR unless they think you have a stake in the equity of the property you mention, which im not qualified to say whether the agreemant you signed does indeed cover you from that possibilaty, so i would recomend cation unless you 100% sure
Thats it, i am done, Blind-as-a-Bat has left the forum, for good this time, there is no way I can recover this account, as the password was random, and not recorded, and the email used no longer exits, nor can be recovered to recover the account, goodbye all …………. :(
