CC Company - Liability for Faulty Goods

I bought a laptop from Dell on my credit card which I paid off in full. However, there was a faulty screen so they sent a replacement but this is also faulty. It's taken 2 weeks of squabbling and excessive time input on my behalf to get here and now I have two faulty laptops - one with a faulty screen and one which slides all over the place because those muppets didn't even bother to check the rubber pads on the bottom were level.

I'm going to email Dell again and ask for a third replacement but what rights do I have with regard to approaching Barclaycard and asking them for a refund? How would it work and would I have to send the laptop to them for a refund or would they just do it if I ask?
That, is an excellent question...

  • You will first have to perservere with Dell until their complaints procedure has been exhausted. If they send you a third laptop and everything is ok no need for anything to go further.
If Dell won play ball and refund you then you can certainly ask Barclaycard to refund you and take the matter up with Dell.

You have rights under s.75 of the Consumer Credit Act 1974. Your credit card company will be liable for any breach of contract by Dell so lodge a complaint asap. Do not get fobbed off by Barclaycard - credit card companies hate these claims. S.75 applies to all transactions over £100 even if you only paid the deposit by credit card.
