off by the government if you are 65 between the 19December 04 and 25 September 05. my partner's dad is 65 on the 26th September so he would get nothing. my partner is asking whether this is age discrimation? should it not be 65 in the qualifying year of 2005!!!!!!!

They always use that week as a cut off date for winter fuel and associated payments. If they set the payments cut off to yr 6/4/2005 to 5/4/2006, you would then have people who lost out by being born on the 6/4/2006.
It is a bit unfair, but they wont change the dates for anyone.I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.0 -
My mum - 75 years - says [slightly toungue in cheek] that it's rather convenient to make an award in respect of the council tax year [for over 65s] 2005-06 well into the year in question as you can rely on a few deaths between the March and September. very cynical!
There are anomalies like this throughout the system however. For instance you pay your national insurance [assuming you work in PAYE employment] right up to your 65th birthday - which can fall anytime - but you only get second state pension benefits for the whole tax years up to the 5th April before your 65th. So you could pay up to 12 months more than another person for the same benefit......under construction.... COVID is a [discontinued] scam0
