Ruthbridge Ltd ( Express Delivery)

I have just received letters for my other half for a debt from 2002. At this time we seperated and he stopped paying all bills due to financial difficulties. We reconciled at the end of 2002 but at this point he couldn`t afford to pay his bills due to him being out of work. Any letters or phone calls received i have always stated he know longer lives here which i have done for the past 6 years but knew it was only a matter of time until they came back as we have a joint mortgage.
The 1st letter was from a company called Express delivery addressed to The Occupier which i rang and quoted ref number only to find out it was in my other half`s name again i told operator he`s no longer lives here.

The 2nd letter was from Ruthbridge Ltd addressed to OH which i rang to say he doesn`t live here but i gave the address of his mum`s to get them off my back because i am frightend of losing my house.
The letter from Ruthbridge is headed LETTER OF NOTICE with proposed plan of an agent calling and OH needs to call to arrange payment of this debt.

Could anybody advise, Help much appreciated.

  • Just return all letters addressed to him marked not known at this address please return to sender. Even if there is no return address. Just pop them back in postbox. Opening your xOH post and calling these companies up is showing that you are still in touch with him. Thats why they continue.

    Just ignore and act as if they are any other stranger.

    Works for us and MIL.
  • Will they not keep mithering because we have a joint mortgage? We have been back together 5 years but we have nothing in his name apart from the mortgage, works documentation and his bank account, all other bills are in my name.

    I think we need some more info really.

    Does he now live at your address?

    Is the bank account in his name at your address?

    How long is it since he last acknowledged this debt in writing or by making a payment?

    What was this debt for, and how much are they claiming?

    Losing your home for a unsecured consumer debt is a minuscule possibility.

    If you haven't paid anything in six years, acknowledged the alleged debt in writing in six years tell 'em to get lost. They are fishing at the moment and have probably bought the debt for a pittance hoping to scare you.

    National Debtline have a wonderful get lost letter for statute barred debts so I would send them that.

    Oh, don't worry about this and NEVER talk to them on the phone.

    As Fermi says though give us more info and help is always at hand

  • OH does live at the address and yes his bank account is registered here but it is not the same bank he had in 2002. The debt he thinks is for his visa card which had a limit of £5000 which he can not remember maxing and they are asking for £7700.
  • Sorry forgot to answer 1 question- He has not aknowledged debt or made any payments he thinks since sept/end of october.

    It's possible that his Credit Reference Files has been linked to your address via his bank account. That often allows debt collectors to trace "absent" debtors.

    I agree with the suggestion of calling National Debtline. This debt may well be statute barred and unenforceable. They will talk the circumstances through with him and work out the best way to tackle this.

    But please be reassured that you are not going to lose your home over a £5,000 - 7,000 credit card debt.

    A debt will be "Statute Barred" if there has been no acknowledgement of the debt by you making a payment or in writing within the relevant limitation period.

    If you are in England/Wales then the limitation period is 6 years and you should read:

    If you are in Scotland then the limitation period is 5 years and you should read:

    If you feel the debt is "Statute Barred", then there is a letter to write at the end of each factsheet.

  • The reason i think about losing my home is because we had a car on finance which was repossesed in 2002 and they caught up with him before chistmas 2007 and sent a bankrupcy proceedings which we took to the CAB who said they could enforce it and that was for only £4300 which i had to borrow of a friend to pay it.

    Lots of creditors like to use bankruptcy as a threat/scare tactic, but very very few ever carry it out. It costs them a fortune in upfront fees with no guarantee of getting a penny back from the Official Receiver.
