What does this mean please?

I sent a copy of my BR order to my creditors a couple of days after going to court. Capital One finally seem to have done something!

So can anyone tell me what this means please (I've recieved 2 - one for each card)

"We have been advised there is a bankruptcy notice against you. We have issued you a default notice because the bankruptcy breaks your capital one terms & conditions." That was a bit of the first page.

This is second page.

"This is a default notice served under Section 87(1) of the CCA 1974.

The credit agreement between you the bank states that if a petition is presented against you, then subject to sending you a Default Notice, we may close your account & demand immediate payment of the outstanding balance.

Nature of Breach:
A BO was made against you. The breach is not capable of remedy.

Further Action. The bank intends:
to terminate the credit agreement
to treat any right conferred on you by the credit agreement as terminated
to enforce the provisions of the CA which became operative on a breach of the CA ******
to submit a claim to the OR or to your trustee in respect of all sums now due th the bank pursuant to the CA **********
to send information about the breach to the credit reference agencies.

The bank intends to take the action set above on or after 28 days of the date of this default notice."

I think I pretty much understand it other than the ones with *****'s.

Do I have to worry about this? Shall I keep them & then tell the OR on Wednesday? Or just sort of do nothing?

So to be a nuisance.:o

  • Hi DebS ap One sent the same to me, its nothing to worry about they are just going through the motions and that was in my case the last i heard from them:D

    You do need to check your CRA file though after discharge to check the date of that and any others are entered correctly after your discharged, as per the sticky at the top of this forum.


    You may also get a letter from a debt collector at the end of your Bankruptcy saying they have bought this or any of your other debts BUT it should clearly state they are not asking you for anything, just your OR, in a vain hope there is something to claim from your BR estate.

    Should you get any that dont say that it is for referance only respond with a copy of your BR order.

    Havnt seen many of those this year though so hopefully they are learning:p

    Thank you. Remind me in 15yrs to check my CRA file - 'cos I reckon the OR will either slap a 15yr order on me or put me in a straightjacket (probably both!).:rolleyes:

    I had one of these and just binned it as i guess they send one to the OR as well but it just weird them sending it to you what a waste of paper and money as if they know you are now BR why not just send it to the OR
