Possible bankruptcy?? Adivce pls

Might seem like a daft question but if i was to be declared bankrupt would it affect my partner?
We live together (not married) and the mortgage is in his name (i am not included in it)
Would this affect him or is the mortgage safe because it is in his name??

It should only effect anything that you have in joint names but someone else here will know the real answer. Welcome to the forum.

This is not a simple answer. It depends how long you have been living together and how much you pay as contribution to the household as well as property value/equity etc. You could be viewed as having a small interest in the property. Do you have children?

Personally I would still complete my forms as having no interest in anything and argue it with the OR if you get a jobsworth. But property is never simple in BR. Neither are cars come to that. Or early discharge!!!

You would possibly have a claim in a court of law if you were to separate, as you have the kids (and they are both yours), so this is going to be a tough one that you are never going to know the answer too until you go BR. If there is masses of equity they may take a peek, if not then its probably not a worry.

Chat to CCCS or Payplan. They should be able to give you some much better answers. As I said, property is a minefield in BR. On the face of it, things should be okay but as with everything in BR, prepare for the worst and the best is a bonus.
